A BILL
To direct the Secretary of Defense to enter into memoranda
of understanding with State and local prosecuting au-
thorities concerning the adjudication of criminal offenses
committed by minors.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Military Installation
4
Non-adult Offender Reform Act’’ or the ‘‘MINOR Act’’.

SEC. 2. MEMORANDA OF UNDERSTANDING ON ADJUDICA-

TION OF CRIMINAL OFFENSES COMMITTED

BY MINORS.

(a) IN GENERAL.—Beginning not later than 90 days
4
after the date of the enactment of this Act, the Secretary
5
of Defense shall seek to enter into a memorandum of un-
6
derstanding concerning the adjudication of criminal of-
7
fenses committed by minors with the head prosecuting au-
8
thority of each State and local jurisdiction of the United
9
States in which there is a Federal military installation.

(b) ELEMENTS.—Each memorandum of under-
11
standing entered into under subsection (a) shall provide
12
that a minor who commits a criminal offense on the
13
grounds of a Federal military installation may, with the
14
consent of the appropriate State or local prosecuting au-
15
thority for the jurisdiction in which the installation is lo-
16
cated, be referred for adjudication to such authority.

SEC. 3. PROGRESS REPORT.

Not later than 180 days after the date of the enact-
19
ment of this Act, the Secretary of Defense shall submit
20
to the congressional defense committees a report on the
21
progress of the Secretary in entering into memoranda of
22
understanding under section 2.

SEC. 4. RULE OF CONSTRUCTION.

Nothing in this Act shall be construed to change the
2
status of a geographic area of exclusive Federal jurisdic-
3
tion.

SEC. 5. DEFINITIONS.

In this Act:
6
(1) The term ‘‘congressional defense commit-
7
tees’’ has the meaning given that term in section
8
101(a)(16) of title 10, United States Code.
9
(2) The term ‘‘minor’’ means a person who has
10
not attained the age of 18 years.
