informed, and evidence-based.

A BILL
To amend the Higher Education Act of 1965 to ensure
that investigations of sexual misconduct by institutions
of higher education are fair, trauma-informed, and evi-
dence-based.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ββTrauma-Informed In-

vestigation Actββ.

SEC. 2. PROGRAM PARTICIPATION AGREEMENTS.

Section 487(a) of the Higher Education Act of 1965

(20 U.S.C. 1094(a)) is amended by adding at the end the
3
following:
4
ββ(30) The institution will ensure that any in-
5
vestigation of sexual harassment or other sexual
6
misconduct carried out by the institution is a trau-
7
ma-informed investigation thatβ
8
ββ(A) is equitable and timely;
9
ββ(B) is conducted in a manner that recog-
10
nizes the emotional, behavioral, developmental,
11
and legal challenges that can accompany trau-
12
ma exposure; and
13
ββ(C) includes evidence-based procedures,
14
informed by cognitive science, that are designed
15
to identify, address, and minimize further trau-
16
ma to victims.ββ.
