Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. WAIVER OF AFFILIATION RULES UNDER THE PAY- 1 CHECK PROTECTION PROGRAM FOR TRIBAL 2 BUSINESS CONCERNS WITH SAME EIN. 3 Section 7(a)(36)(D) of the Small Business Act (15 4 U.S.C. 636(a)(36)(D)) is amended— 5 (1) in clause (v), by striking ‘‘, veterans organi- 6 zation, or Tribal business concern’’ and inserting ‘‘or 7 veterans organization’’; and 8 (2) by adding at the end the following: 9 ‘‘(vii) NO AFFILIATION BETWEEN 10 TRIBAL BUSINESS CONCERNS BASED ON 11 SHARED EIN.—During the covered period, 12 for purposes of determining eligibility for a 13 covered loan, affiliation shall not be found 14 under section 121.103 of title 13, Code of 15 Federal Regulations, or any successor reg- 16 ulation, between Tribal business concerns 17 described in section 31(b)(2)(C) based 18 solely on a shared employer identification 19 number.’’. 20 Æ VerDate Sep 11 2014 21:25 Aug 26, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\S4446.IS S4446 pamtmann on DSKBC07HB2PROD with BILLS
