A BILL
To require States and units of local governments to enforce
stay-at-home orders equally, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Equal Opportunity
4
First Amendment Act’’.
5
SEC. 2. EQUAL ENFORCEMENT OF STAY-AT-HOME ORDERS.

In the case that a State or unit of local government
7
issues an order that limits gatherings to a certain number

of people pursuant to a national emergency declared by

the President under the National Emergencies Act (50
2
U.S.C. 1601 et seq.) or a similar State emergency declara-
3
tion, the State or unit of local government may not dis-
4
criminate in the enforcement of such order, in the case
5
of persons who are exercising a right protected under the
6
First Amendment.

SEC. 3. PRIVATE RIGHT OF ACTION.
8
A person who is harmed by a violation of section 2
9
may bring an action in the appropriate district court of
10
the United States seeking relief.
