To require elementary schools and secondary schools to pro-
vide an option for safe, in-person attendance during
school year 2020–2021.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Educational Flexibility
4
for Families Act’’.

SEC. 2. REQUIREMENT FOR SAFE, IN-PERSON ATTENDANCE
6
OPTION.

(a) IN GENERAL.—Beginning on the date of enact-
8
ment of this Act, no amounts are authorized to be appro-
9
priated for school year 2020–2021 to any elementary

school or secondary school, or any local educational agency

or State educational agency that serves an elementary
2
school or secondary school, that does not provide an option
3
for students to attend classes, safely and in-person, at the
4
school during such school year.

(b) DEFINITIONS.—The terms ‘‘elementary school’’,
6
‘‘secondary school’’, ‘‘local educational agency’’, and
7
‘‘State educational agency’’ have the meanings given the
8
terms in section 8101 of the Elementary and Secondary
9
Education Act of 1965 (20 U.S.C. 7801).
