SHORT TITLE. 1 This Act may be cited as the ‘‘Providing Adequate 2 Resources to Enhance Needed Time with Sons and 3 Daughters Act of 2020’’ or the ‘‘PARENTS Act of 2020’’. 4 SEC. 2. EXPANDING PERMITTED USES OF INCENTIVE PAY- 5 MENTS. 6 Section 458 of the Social Security Act (42 U.S.C. 7 658a) is amended— 8 (1) in subsection (f)— 9 (A) in paragraph (1), by striking ‘‘; or’’ 10 and inserting a semicolon; 11 (B) by redesignating paragraph (2) as 12 paragraph (3); and 13 (C) by inserting after paragraph (1) the 14 following new paragraph: 15 ‘‘(2) to develop, implement, and evaluate proce- 16 dures for establishing a parenting time agreement 17 when establishing an initial or modified child sup- 18 port order or a medical support order (including pro- 19 cedures for carrying out a parenting time agreement 20 made prior to the establishment or modification of 21 any such order); or’’; and 22 (2) by adding at the end the following new sub- 23 section: 24 ‘‘(g) DEFINITIONS OF PARENTING TIME AGREEMENT 25 AND NONCUSTODIAL PARENT.— 26 VerDate Sep 11 2014 01:12 Aug 09, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H7725.IH H7725 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 7725 IH ‘‘(1) PARENTING TIME AGREEMENT.—For pur- 1 poses of subsection (f)(2), the term ‘parenting time 2 agreement’ means an agreement governing how 3 much time a child spends with the child’s custodial 4 parent and the child’s noncustodial parent that is 5 mutually agreed to by the parents and is not con- 6 tested by either parent in any forum. 7 ‘‘(2) NONCUSTODIAL PARENT.—For purposes 8 of paragraph (1), the term ‘noncustodial parent’ 9 means the parent of a child that the child does not 10 live with for the majority of the child’s time.’’. 11 Æ VerDate Sep 11 2014 01:12 Aug 09, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H7725.IH H7725 kjohnson on DSK79L0C42PROD with BILLS
