A BILL
To direct the United States Trade Representative to extend
the exclusions of goods of China from additional duties
imposed under section 301 of the Trade Act of 1974,
and for other purposes.
Be it enacted by the Senate and House of Representa-

SECTION 1. EXTENSION OF EXCLUSIONS OF GOODS OF
1
CHINA FROM ADDITIONAL DUTIES IMPOSED
2
UNDER SECTION 301 OF THE TRADE ACT OF
3
1974.

(a) IN GENERAL.—Not later than 30 days after the
5
date of the enactment of this Act, the United States Trade
6
Representative—
7
(1) shall extend the date of expiration of each
8
exclusion of a good of China from additional duties
9
imposed under section 301 of the Trade Act of 1974
10
(19 U.S.C. 2411) that has been granted under the
11
authority of such section and is in effect as of July
12
16, 2020 for a period of not less than one year from
13
such date of expiration; and
14
(2) shall publish in the Federal Register a no-
15
tice of such extension.

(b) EXCEPTION.—The Trade Representative is not
17
required to extend the date of expiration of the exclusion
18
of a good of China from additional duties as described in
19
subsection (a) if, not later than fifteen days after the date
20
of the enactment of this Act, the Trade Representative—
21
(1) determines that—
22
(A) the good is strategically important or
23
related to ‘‘Made in China 2025’ ’’ or other Chi-
24
nese industrial programs; and

(B) extension of such date of expiration

would cause severe harm to the United States;
2
and
3
(2) provides a detailed justification for such de-
4
termination to—
5
(A) the Committee on Ways and Means of
6
the House of Representatives and the Com-
7
mittee on Finance of the Senate; and
8
(B) the party that requested the exclusion;
9
and
10
(3) publishes in the Federal Register a notice of
11
such determination.

(c) U.S. CUSTOMS AND BORDER PROTECTION.—Not
13
later than 30 days after the date of enactment of this Act,
14
the Commissioner of U.S. Customs and Border Protection
15
shall issue updated instructions with respect to entry guid-
16
ance and implementation of this Act.
