Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Concerns Over Nations 4 Funding University Campus Institutes in the United 5 States Act’’ or the ‘‘CONFUCIUS Act’’. 6 SEC. 2. RESTRICTIONS ON CONFUCIUS INSTITUTES. 7 (a) DEFINITION.—In this section, the term ‘‘Confu- 8 cius Institute’’ means a cultural institute directly or indi- 9 VerDate Sep 11 2014 04:47 Aug 04, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H7601.IH H7601 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 7601 IH rectly funded by the Government of the People’s Republic 1 of China. 2 (b) RESTRICTIONS ON CONFUCIUS INSTITUTES.—An 3 institution of higher education or other postsecondary edu- 4 cational institution (referred to in this section as an ‘‘insti- 5 tution’’) shall not be eligible to receive Federal funds from 6 the Department of Education (except funds under title IV 7 of the Higher Education Act of 1965 (20 U.S.C. 1070 8 et seq.) or other Department of Education funds that are 9 provided directly to students) unless the institution en- 10 sures that any contract or agreement between the institu- 11 tion and a Confucius Institute includes clear provisions 12 that— 13 (1) protect academic freedom at the institution; 14 (2) prohibit the application of any foreign law 15 on any campus of the institution; and 16 (3) grant full managerial authority of the Con- 17 fucius Institute to the institution, including full con- 18 trol over what is being taught, the activities carried 19 out, the research grants that are made, and who is 20 employed at the Confucius Institute. 21 Æ VerDate Sep 11 2014 04:47 Aug 04, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\H7601.IH H7601 kjohnson on DSK79L0C42PROD with BILLS
