IN THE HOUSE OF REPRESENTATIVES JULY 9, 2020 Mr. CLEAVER (for himself and Mr. FORTENBERRY) introduced the following bill; which was referred to the Committee on Appropriations, and in addi- tion to the Committee on the Budget, for a period to be subsequently de- termined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned A BILL To provide supplemental appropriations to U.S. Citizenship and Immigration Services, and for other purposes. Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 That the following sums are appropriated, out of any 3 money in the Treasury not otherwise appropriated, for the 4 fiscal year ending September 30, 2020, for the following 5 purpose, namely: 6 VerDate Sep 11 2014 18:13 Jul 27, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H7508.IH H7508 pamtmann on DSKBC07HB2PROD with BILLS 2 •HR 7508 IH DEPARTMENT OF HOMELAND SECURITY 1 RESEARCH, DEVELOPMENT, TRAINING, AND SERVICES 2 U.S. CITIZENSHIP AND IMMIGRATION SERVICES 3 OPERATIONS AND SUPPORT 4 For an additional amount for ‘‘Operations and Sup- 5 port’’, for necessary expenses related to providing immi- 6 gration adjudication and naturalization services, such 7 sums as may be necessary up to $1,221,000,000 to main- 8 tain the projected fiscal year 2020 and 2021 levels of oper- 9 ations, including maintaining current staffing levels and 10 current contracts at full performance, which shall be avail- 11 able until December 31, 2020: Provided, That U.S. Citi- 12 zenship and Immigration Services shall report every 30 13 days to the Committee on the Judiciary, the Committee 14 on Homeland Security, and the Committee on Appropria- 15 tions of the House of Representatives and the Committee 16 on the Judiciary, the Committee on Homeland Security 17 and Governmental Affairs, and the Committee on Appro- 18 priations of the Senate on obligations and expenditures 19 from the amount provided under this heading: Provided 20 further, That the amount provided under this heading is 21 designated by the Congress as being for an emergency re- 22 quirement pursuant to section 251(b)(2)(A)(i) of the Bal- 23 anced Budget and Emergency Deficit Control Act of 1985: 24 Provided further, That the amount provided under this 25 VerDate Sep 11 2014 18:13 Jul 27, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H7508.IH H7508 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 7508 IH heading shall be available only if the President designates 1 such amount as being for an emergency requirement pur- 2 suant to section 251(b)(2)(A)(i) of such Act. 3 ADMINISTRATIVE PROVISIONS 4 (INCLUDING TRANSFER OF FUNDS) 5 SEC. 101. (a) For fiscal year 2020, and for each fis- 6 cal year thereafter until the total amount of the sur- 7 charges collected under this section equals the amount of 8 the supplemental appropriation provided in this Act for 9 ‘‘Operations and Support’’, each applicant paying the pre- 10 mium fee authorized under section 286(u) of the Immigra- 11 tion and Nationality Act (8 U.S.C. 1356(u)) shall pay a 12 surcharge in addition to such fee. The surcharge shall 13 equal 10 percent of such premium fee, rounded up to the 14 nearest dollar. 15 (b) Notwithstanding any other provision of law, in- 16 cluding the Administrative Procedure Act (5 U.S.C. 551 17 et seq.) and the Paperwork Reduction Act (44 U.S.C. 18 3501 et seq.), beginning 60 days after the date of the en- 19 actment of this Act, the Secretary of Homeland Security 20 shall begin collecting the surcharge described in subsection 21 (a) and shall reject any petition or application submitted 22 without payment for such surcharge, if applicable. Not- 23 withstanding any other provision of law, including sub- 24 sections (m), (n), and (u) of section 286 of the Immigra- 25 VerDate Sep 11 2014 18:13 Jul 27, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H7508.IH H7508 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 7508 IH tion and Nationality Act (8 U.S.C. 1356), the Secretary 1 shall deposit all surcharges collected under this section 2 into the general fund of the Treasury. 3 (c)(1) Notwithstanding any other provision of law, 4 the amounts collected under this section are designated 5 by the Congress as being for an emergency requirement 6 pursuant to section 251(b)(2)(A)(i) of the Balanced Budg- 7 et and Emergency Deficit Control Act of 1985, and such 8 amounts shall only be collected if the President designates 9 such amounts as an emergency requirement pursuant to 10 section 251(b)(2)(A)(i). 11 (2) The budgetary effects of this section are des- 12 ignated as an emergency requirement pursuant to section 13 4(g) of the Statutory Pay-As-You-Go Act of 2010 (2 14 U.S.C. 933(g)). 15 (3) In the Senate, this section is designated as an 16 emergency requirement pursuant to section 4112(a) of H. 17 Con.
