Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Stop Home Manufac- 4 ture of Ghost Guns Act of 2020’’. 5 SEC. 2. PROHIBITIONS RELATING TO FIREARM MANUFAC- 6 TURING MACHINES. 7 (a) PROHIBITIONS.—Section 922 of title 18, United 8 States Code, is amended by adding at the end the fol- 9 lowing: 10 VerDate Sep 11 2014 05:40 Jul 24, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H7468.IH H7468 pbinns on DSKJLVW7X2PROD with BILLS 2 •HR 7468 IH ‘‘(aa)(1) It shall be unlawful for any person, in or 1 affecting interstate or foreign commerce, to transfer or 2 offer to transfer to any person other than a licensed manu- 3 facturer a firearm manufacturing machine. 4 ‘‘(2)(A) Except as provided in subparagraph (B), it 5 shall be unlawful for any person other than a licensed 6 manufacturer, in or affecting interstate or foreign com- 7 merce, to possess or purchase a firearm manufacturing 8 machine. 9 ‘‘(B) Subparagraph (A) shall not apply to a person 10 who is engaged in the business of selling manufacturing 11 equipment to a licensed manufacturer, and who possesses 12 a firearm manufacturing machine with the intent to trans- 13 fer the machine to a licensed manufacturer.’’. 14 (b) DEFINITION OF FIREARM MANUFACTURING MA- 15 CHINE.—Section 921(a) of such title is amended by add- 16 ing at the end the following: 17 ‘‘(36) The term ‘firearm manufacturing machine’ 18 means— 19 ‘‘(A) a device designed or redesigned, made or 20 remade, and intended to be used primarily to make, 21 or convert a product into, a frame or receiver for a 22 firearm; and 23 ‘‘(B) any combination of parts designed or in- 24 tended for use in making a device described in sub- 25 VerDate Sep 11 2014 05:40 Jul 24, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H7468.IH H7468 pbinns on DSKJLVW7X2PROD with BILLS 3 •HR 7468 IH paragraph (A) and from which such a device may be 1 readily assembled.’’. 2 (c) PENALTIES.—Section 924 of such title is amend- 3 ed— 4 (1) in subsection (a)(1)(B), by striking ‘‘or (q)’’ 5 and inserting ‘‘(q), or (aa)’’; 6 (2) in subsection (d)(1)— 7 (A) by inserting ‘‘and any firearm manu- 8 facturing machine involved in any knowing vio- 9 lation of section 922(aa),’’ before ‘‘shall be sub- 10 ject’’; and 11 (B) by striking ‘‘firearms or ammunition’’ 12 each place it appears and inserting ‘‘firearms, 13 ammunition, or firearm manufacturing ma- 14 chine’’; and 15 (3) in subsection (d)(2)— 16 (A) in subparagraph (A), by striking ‘‘fire- 17 arms or ammunition’’ and inserting ‘‘firearms, 18 ammunition, and firearm manufacturing ma- 19 chines’’; and 20 (B) in subparagraph (C), by striking ‘‘fire- 21 arms or quantities of ammunition’’ and insert- 22 ing ‘‘firearms, quantities of ammunition, or 23 firearm manufacturing machines’’. 24 VerDate Sep 11 2014 05:40 Jul 24, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H7468.IH H7468 pbinns on DSKJLVW7X2PROD with BILLS 4 •HR 7468 IH (d) EFFECTIVE DATE.—The amendments made by 1 this section shall apply to conduct engaged in on or after 2 January 1, 2022. 3 Æ VerDate Sep 11 2014 05:40 Jul 24, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H7468.IH H7468 pbinns on DSKJLVW7X2PROD with BILLS
