SHORT TITLE. 1 This Act may be cited as the ‘‘Confederate Monu- 2 ment Removal Act’’. 3 SEC. 2. REQUIREMENTS AND REMOVAL PROCEDURES. 4 (a) REQUIREMENTS.—Section 1814 of the Revised 5 Statutes (2 U.S.C. 2131) is amended by inserting ‘‘(other 6 than persons who served voluntarily with the Confederate 7 States of America)’’ after ‘‘military services’’. 8 (b) STATUE REMOVAL PROCEDURES.— 9 (1) IN GENERAL.—The Architect of the Capitol 10 shall— 11 (A) identify all statues on display in the 12 United States Capitol that do not meet the re- 13 quirements of section 1814 of the Revised Stat- 14 utes (2 U.S.C. 2131), as amended by subsection 15 (a); and 16 (B) subject to the approval of the Joint 17 Committee on the Library of Congress, arrange 18 for the removal of each such statue from the 19 Capitol by not later than 120 days after the 20 date of enactment of this Act. 21 (2) REMOVAL AND RETURN OF STATUES.— 22 (A) IN GENERAL.—Subject to subpara- 23 graph (C), the Architect of the Capitol shall ar- 24 range to transfer and deliver any statue that is 25 VerDate Sep 11 2014 04:03 Jul 02, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H7217.IH H7217 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 7217 IH removed under this subsection to the Smithso- 1 nian Institution. 2 (B) STORAGE OR DISPLAY OF STATUES.— 3 The Board of Regents of the Smithsonian Insti- 4 tution shall follow the policies and procedures 5 of the Smithsonian Institution, as in effect on 6 the day before the date of enactment of this 7 Act, regarding the storage and display of any 8 statue transferred under subparagraph (A). 9 (C) STATE REQUESTS.—A statue provided 10 for display by a State that is removed under 11 this subsection shall be returned to the State, 12 and the ownership of the statue transferred to 13 the State, if the State so requests and agrees 14 to pay any costs related to the transportation of 15 the statue to the State. 16 (3) REPLACEMENT OF STATUES.—A State that 17 has a statue removed under this subsection shall be 18 able to replace such statue in accordance with the 19 requirements and procedures of section 1814 of the 20 Revised Statutes (2 U.S.C. 2131) and section 311 of 21 the Legislative Branch Appropriations Act, 2001 (2 22 U.S.C. 2132). 23 (4) AUTHORIZATION AND APPROPRIATIONS.— 24 VerDate Sep 11 2014 04:03 Jul 02, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H7217.IH H7217 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 7217 IH (A) IN GENERAL.—There are appropriated 1 for the fiscal year ending September 30, 2017, 2 out of any money in the Treasury not otherwise 3 appropriated, $5,000,000 to carry out this sec- 4 tion, including the costs related to the removal, 5 transfer, security, storage, and display of the 6 statues described in paragraph (1)(A), of 7 which— 8 (i) $2,000,000 shall be made available 9 to the Architect of the Capitol; and 10 (ii) $3,000,000 shall be made avail- 11 able to the Smithsonian Institution. 12 (B) AVAILABILITY.—Amounts appro- 13 priated under subparagraph (A) shall remain 14 available until expended. 15 Æ VerDate Sep 11 2014 04:03 Jul 02, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H7217.IH H7217 pamtmann on DSKBC07HB2PROD with BILLS
