Mr. COOK (for himself, Mr. CARBAJAL, Mr. LAMALFA, and Mr. PANETTA) in-
troduced the following bill; which was referred to the Committee on Over-
sight and Reform, and in addition to the Committee on Natural Re-
sources, for a period to be subsequently determined by the Speaker, in
each case for consideration of such provisions as fall within the jurisdic-
tion of the committee concerned
A BILL
To amend title VI of the Social Security Act to establish
the Coronavirus County Relief Fund, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Coronavirus County
4
Relief and Stability Act’’.

SEC. 2. CORONAVIRUS COUNTY RELIEF FUND.

Title VI of the Social Security Act (as added by sec-
2
tion 5001 of the CARES Act (Public Law 116–136)) is
3
amended by adding after section 601 the following:
4
‘‘SEC. 602. CORONAVIRUS COUNTY RELIEF FUND.
5
‘‘(a) APPROPRIATION.—Out of any money in the
6
Treasury of the United States not otherwise appropriated,
7
there are appropriated for making payments to counties
8
under this section, $36,000,000,000 for fiscal year 2020.
9
‘‘(b) AUTHORITY TO MAKE PAYMENTS.—Not later
10
than 30 days after the date of enactment of this section,
11
the Secretary shall pay each county that submits the cer-
12
tification described in section (e) the amount determined
13
for the county for fiscal year 2020 under subsection (c).
14
‘‘(c) PAYMENT AMOUNTS.—
15
‘‘(1) IN
GENERAL.—The amount paid under
16
this section for fiscal year 2020 to a county shall be
17
an amount equal to the sum of—
18
‘‘(A) $1,000,000; and
19
‘‘(B) the amount equal to the relative pop-
20
ulation proportion amount determined under
21
paragraph (2) for such fiscal year.

under this paragraph for a county for fiscal year
1
2020 is the product of—
2
‘‘(A) the portion of the amount appro-
3
priated under subsection (a) for fiscal year
4
2020 remaining after taking into account
5
amounts paid pursuant to paragraph (1)(A);
6
and
7
‘‘(B) the relative county population propor-
8
tion (as defined in paragraph (3)).
9
‘‘(3) RELATIVE COUNTY POPULATION PROPOR-
10
TION DEFINED.—For purposes of paragraph (2)(B),
11
the term ‘relative county population proportion’
12
means, with respect to a county, the quotient of—
13
‘‘(A) the population of the county; and
14
‘‘(B) the total population of all counties.
15
‘‘(4) DATA.—For purposes of this subsection,
16
the population of counties shall be determined based
17
on the most recent year for which data are available
18
from the Bureau of the Census and shall include all
19
incorporated and unincorporated populations within
20
the county.
21
‘‘(d) USE OF FUNDS.—A county shall use the funds
22
provided under a payment made under this section—
23
‘‘(1) to cover only those costs of the county
24
that—

‘‘(A) are necessary expenditures incurred
1
due to the public health emergency with respect
2
to the Coronavirus Disease 2019 (COVID-19);
3
‘‘(B) were not accounted for in the budget
4
most recently approved as of February 29,
5
2020; and
6
‘‘(C) were incurred during the period that
7
begins on March 1, 2020, and ends on Decem-
8
ber 30, 2020; and
9
‘‘(2) to compensate for any direct loss of rev-
10
enue to the county as a result of such public health
11
emergency.

‘‘(e) CERTIFICATION.—In order to receive a payment
13
under this section, a county shall provide the Secretary
14
with a certification signed by the Chief Executive for the
15
county that the county’s proposed uses of the funds are
16
consistent with subsection (d).

‘‘(f)
INSPECTOR
GENERAL
OVERSIGHT;
18
RECOUPMENT.—
19
‘‘(1) OVERSIGHT
AUTHORITY.—The Inspector
20
General of the Department of the Treasury shall
21
conduct monitoring and oversight of the receipt, dis-
22
bursement, and use of funds made available under
23
this section.

‘‘(2) RECOUPMENT.—If the Inspector General
1
of the Department of the Treasury determines that
2
a county has failed to comply with subsection (d),
3
the amount equal to the amount of funds used in
4
violation of such subsection shall be booked as a
5
debt of such entity owed to the Federal Government.
6
Amounts recovered under this subsection shall be de-
7
posited into the general fund of the Treasury.
8
‘‘(3) APPROPRIATION.—Out of any money in
9
the Treasury of the United States not otherwise ap-
10
propriated, there are appropriated to the Office of
11
the Inspector General of the Department of the
12
Treasury, $8,500,000 to carry out oversight and
13
recoupment
activities
under
this
subsection.
14
Amounts appropriated under the preceding sentence
15
shall remain available until expended.
16
‘‘(4) AUTHORITY
OF
INSPECTOR
GENERAL.—
17
Nothing in this subsection shall be construed to di-
18
minish the authority of any Inspector General, in-
19
cluding such authority as provided in the Inspector
20
General Act of 1978 (5 U.S.C. App.).
21
‘‘(g) DEFINITIONS.—In this section:
22
‘‘(1) COUNTY.—The term ‘county’ means a par-
23
ish in Louisiana, a borough in Alaska, or a county
24
in the other 48 States.

‘‘(2) SECRETARY.—The term ‘Secretary’ means

the Secretary of the Treasury.’’.

SEC. 3. REAUTHORIZATION OF PAYMENTS IN LIEU OF
3
TAXES PROGRAM.
4
Section 6906 of title 31, United States Code, is
5
amended in the matter preceding paragraph (1) by strik-
6
ing ‘‘fiscal year 2019’’ and inserting ‘‘each of fiscal years
7
2021 through 2025’’.
