Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Reopening America 4 by Supporting Workers and Businesses Act of 2020’’. 5 SEC. 2. TIME-LIMITED BACK-TO-WORK BONUSES. 6 (a) IN GENERAL.—Section 2104(b) of the Cares Act 7 (Public Law 116–136) is amended— 8 VerDate Sep 11 2014 20:47 Jun 25, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H7066.IH H7066 jbell on DSKJLSW7X2PROD with BILLS 2 •HR 7066 IH (1) by redesignating paragraph (2) as para- 1 graph (3); and 2 (2) by inserting after paragraph (1) the fol- 3 lowing: 4 ‘‘(2) BACK-TO-WORK BONUSES.— 5 ‘‘(A) IN GENERAL.—Any agreement under 6 this section may also provide that the State 7 agency of the State may make not more than 8 2 weekly payments each in the amount of $600 9 to each individual who— 10 ‘‘(i) was eligible for Federal Pandemic 11 Unemployment Compensation under para- 12 graph (1) for any week beginning after the 13 date of enactment of the Reopening Amer- 14 ica by Supporting Workers and Businesses 15 Act of 2020; and 16 ‘‘(ii) is no longer so eligible (as deter- 17 mined by the State), as a result of earn- 18 ings due to commencing employment, for 19 the week immediately following such week. 20 ‘‘(B) DURATION.—Payments to an indi- 21 vidual under this paragraph shall begin with 22 the week described in subparagraph (A)(ii) and 23 shall end with the earlier of— 24 VerDate Sep 11 2014 20:47 Jun 25, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H7066.IH H7066 jbell on DSKJLSW7X2PROD with BILLS 3 •HR 7066 IH ‘‘(i) the week following the week de- 1 scribed in subparagraph (A)(ii); or 2 ‘‘(ii) the last week with respect to 3 which such agreement applies. 4 ‘‘(C) OPTION TO PROVIDE PAYMENTS AS A 5 LUMP SUM.—At the option of the State, pay- 6 ments to an individual under this paragraph for 7 weeks described in subparagraph (B) may be 8 paid as a lump sum of $1,200. 9 ‘‘(D) SPECIAL RULE.—Payments made 10 pursuant to an agreement under this paragraph 11 shall not be considered to violate the withdrawal 12 requirements of section 303(a)(5) of the Social 13 Security Act (42 U.S.C. 503(a)(5)) or section 14 3304(a)(4) of the Internal Revenue Code of 15 1986.’’. 16 (b) CONFORMING AMENDMENTS.—Section 2104 of 17 such Act is amended— 18 (1) by inserting ‘‘and payments under sub- 19 section (b)(2)’’ after ‘‘Federal Pandemic Unemploy- 20 ment Compensation’’ each place it appears in sub- 21 section (d) or (f) of such section; and 22 (2) in subsection (g), by inserting ‘‘, as such 23 provisions apply with respect to Federal Pandemic 24 VerDate Sep 11 2014 20:47 Jun 25, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H7066.IH H7066 jbell on DSKJLSW7X2PROD with BILLS 4 •HR 7066 IH Unemployment Compensation,’’ after ‘‘the preceding 1 provisions of this section’’. 2 SEC. 3. RETURN TO WORK REPORTING. 3 Subtitle A of title II of division A of the CARES Act 4 (Public Law 116–136) is amended by adding at the end 5 the following: 6 ‘‘SEC. 2117. RETURN TO WORK REPORTING. 7 ‘‘Each State participating in an agreement under any 8 of the preceding sections of this subtitle shall have in ef- 9 fect a procedure to address any circumstances in which, 10 during any period during which such agreement is in ef- 11 fect, claimants of unemployment compensation refuse to 12 return to work or to accept an offer of suitable work with- 13 out good cause. Such procedures shall include the fol- 14 lowing: 15 ‘‘(1) A reporting mechanism for employers, 16 such as through a phone line, email, or online portal, 17 to notify the State agency when an individual re- 18 fuses an offer of employment. 19 ‘‘(2) A plain-language notice provided to such 20 claimants about State return to work laws, rights to 21 refuse to return to work or to refuse suitable work, 22 and information on contesting the denial of a claim 23 that has been denied due to a report by an employer 24 VerDate Sep 11 2014 20:47 Jun 25, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H7066.IH H7066 jbell on DSKJLSW7X2PROD with BILLS 5 •HR 7066 IH that the claimant refused to return to work or re- 1 fused suitable work.’’. 2 SEC. 4. TECHNICAL CORRECTIONS FOR GOVERNMENTAL 3 ENTITIES AND NONPROFIT ORGANIZATIONS. 4 Section 903(i)(1) of the Social Security Act, as added 5 by section 2103 of the CARES Act (Public Law 116–136), 6 is amended— 7 (1) in subparagraph (A), by striking ‘‘during 8 the applicable period’’ and inserting ‘‘with respect to 9 the applicable period’’; 10 (2) in subparagraph (B), by striking ‘‘section 11 3309(a)(1)’’ and inserting ‘‘section 3309(a)’’; and 12 (3) in subparagraph (C), by striking ‘‘shall be 13 used exclusively’’ and all that follows through the 14 end and inserting ‘‘shall be used exclusively to re- 15 duce the amounts required to be paid in lieu of con- 16 tributions into the State unemployment fund pursu- 17 ant to such section by governmental entities and 18 other organizations described in section 3309(a) of 19 such Code’’. 20 Æ VerDate Sep 11 2014 20:47 Jun 25, 2020 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H7066.IH H7066 jbell on DSKJLSW7X2PROD with BILLS
