A BILL
To require the Secretary of Health and Human Services
issue regulations to ensure due process rights for physi-
cians furnishing emergency medical services.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Emergency Room Hero
4
and Patient Safety Act’’ or the ‘‘ER Hero and Patient
5
Safety Act’’.

SEC. 2. REGULATIONS TO ENSURE DUE PROCESS RIGHTS

FOR PHYSICIANS FURNISHING EMERGENCY

MEDICAL SERVICES.

The Secretary of Health and Human Services shall,
4
as soon as practicable after the date of the enactment of
5
this Act, but not later than one year after such date,
6
through rulemaking, issue final regulations to provide that
7
physicians who are employed by or under contract with
8
a hospital for furnishing emergency medical services have
9
a fair hearing and appellate review through appropriate
10
medical staff mechanisms before any termination or re-
11
striction of the professional activity of such physicians or
12
staff privileges of such physicians at such hospital and
13
that such a hearing and review are not denied through
14
a third-party contract.
