A BILL
To ensure that additional unemployment benefits do not re-
sult in an individual receiving unemployment compensa-
tion that is more than the amount of wages the indi-
vidual was earning prior to becoming unemployed.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Getting Americans
4
Back to Work Act’’.

SEC. 2. LIMITATION ON TOTAL UNEMPLOYMENT BENEFITS.

(a) IN GENERAL.—Subtitle A of title II of division
2
A of the CARES Act (Public Law 116–136) is amended
3
by inserting after section 2107 the following:
4
‘‘SEC. 2107A. LIMITATION ON TOTAL UNEMPLOYMENT BEN-
5
EFITS.

‘‘(a) IN GENERAL.—Notwithstanding sections 2102,
7
2104, and 2107, in no case may the sum of unemployment
8
benefits paid to an individual under such sections and as
9
determined under State law for any week exceed the
10
amount of the individual’s average weekly wages for an
11
appropriate period prior to the receipt of assistance under
12
such sections, as determined by the Secretary of Labor.

‘‘(b) REPORTING; RECOVERY.—The Secretary of
14
Labor shall, in accordance with applicable laws and regu-
15
lations, have the authority to require such wage reporting
16
as needed to implement this section and to recover any
17
amounts paid in excess of any limit established by law.’’.
18
(b) EFFECTIVE DATE.—The amendment made by
19
subsection (a) shall apply with respect to weeks of unem-
20
ployment beginning on or after June 1, 2020.
