SHORT TITLE. 1 This Act may be cited as the ‘‘Children’s Health In- 2 surance Program Pandemic Enhancement and Relief Act’’ 3 or the ‘‘CHIPPER Act’’. 4 SEC. 2. INCREASING THE CHIP ENHANCED FMAP TO HELP 5 STATES RESPOND TO THE COVID–19 PAN- 6 DEMIC. 7 Section 2105(b) of the Social Security Act (42 U.S.C. 8 1397ee(b)) is amended— 9 (1) by striking ‘‘For purposes of subsection 10 (a),’’ and inserting the following: 11 ‘‘(1) IN GENERAL.—For purposes of subsection 12 (a),’’; 13 (2) in the second sentence— 14 (A) by inserting ‘‘, subject to paragraph 15 (2),’’ after ‘‘23 percentage points, and’’; and 16 (B) by striking ‘‘September 30, 2020’’ and 17 inserting ‘‘September 30, 2021’’; and 18 (3) by adding at the end the following new 19 paragraph: 20 ‘‘(2) REQUIREMENTS.—During the period that 21 begins on October 1, 2020, and ends on September 22 30, 2021, a State shall not receive the increase de- 23 scribed in the second sentence of paragraph (1) to 24 the enhanced FMAP for such State, with respect to 25 a quarter that occurs during such period, if— 26 VerDate Sep 11 2014 04:22 May 27, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H6797.IH H6797 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 6797 IH ‘‘(A) the amount of any premium imposed 1 by the State under the State child health plan 2 (or a waiver of such plan) during such quarter, 3 with respect to an individual enrolled under 4 such plan (or waiver), exceeds the amount of 5 such premium as of January 1, 2020; 6 ‘‘(B) the State fails to provide that an in- 7 dividual who is enrolled for benefits under such 8 plan (or waiver) as of the date of enactment of 9 this paragraph or enrolls for benefits under 10 such plan (or waiver) during the period begin- 11 ning on such date of enactment and ending on 12 the last day of the month in which the emer- 13 gency period defined in paragraph (1)(B) of 14 section 1135(g) ends shall be treated as eligible 15 for such benefits through the end of the month 16 in which such emergency period ends unless the 17 individual requests a voluntary termination of 18 eligibility or the individual ceases to be a resi- 19 dent of the State; 20 ‘‘(C) the State does not provide coverage 21 under such plan (or waiver), without the impo- 22 sition of cost sharing, during such quarter for 23 any testing services and treatments for 24 VerDate Sep 11 2014 04:22 May 27, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H6797.IH H6797 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 6797 IH COVID–19, including vaccines, specialized 1 equipment, and therapies; 2 ‘‘(D) the State imposes a waiting period 3 under the State child health plan prior to the 4 provision of child health assistance to a tar- 5 geted low-income child; or 6 ‘‘(E) the State fails to take active meas- 7 ures (as determined by the Secretary) to iden- 8 tify and re-enroll children who are eligible for 9 child health assistance under the State plan and 10 who were previously enrolled in such plan.’’. 11 Æ VerDate Sep 11 2014 04:22 May 27, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H6797.IH H6797 kjohnson on DSK79L0C42PROD with BILLS
