A BILL
To amend title XIX of the Social Security Act to require
States to provide coverage under the Medicaid program
for certain individuals during national emergencies, and
for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Emergency Medicaid
4
for Coronavirus Treatment Act’’.

SEC. 2. REQUIREMENT FOR STATES TO PROVIDE MEDICAID

COVERAGE FOR CERTAIN INDIVIDUALS DUR-
2
ING NATIONAL EMERGENCIES.

(a) IN GENERAL.—Section 1902 of the Social Secu-
4
rity Act (42 U.S.C. 1396a) is amended—
5
(1) in subsection (a)(10)(A)(i)—
6
(A) in subclause (VIII), by striking ‘‘or’’ at
7
the end;
8
(B) in subclause (IX), by adding ‘‘or’’ at
9
the end; and
10
(C) by inserting after subclause (IX) the
11
following new subclause:

‘‘(X) during any period in which
13
there exists an emergency declared by
14
the President pursuant to the Na-
15
tional Emergencies Act or the Robert
16
T. Stafford Disaster Relief and Emer-
17
gency Assistance Act with respect to a
18
disease, who are diagnosed with such
19
disease;’’; and
20
(2) in subsection (e), by adding at the end the
21
following new paragraph:

‘‘(16) CONTINUED ELIGIBILITY FOR MED-
23
ICAL
ASSISTANCE
FOR
CERTAIN
INDIVIDUALS

AFTER NATIONAL EMERGENCIES.—In the case
25
of an individual who enrolls under the State

plan (or a waiver of such plan) pursuant to
1
subsection (a)(10)(A)(i)(X) during a period de-
2
scribed in such subsection with respect to a dis-
3
ease, such individual shall continue to be eligi-
4
ble under the State plan (or waiver) after the
5
end of such period for any medical assistance
6
available under the State plan (or waiver) re-
7
lated to treatment, including testing services,
8
for such disease.’’.

(b) EFFECTIVE DATE.—This Act and the amend-
10
ments made by this Act shall take effect as if enacted on
11
March 13, 2020.
