Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. FAMILY CARE FOR ESSENTIAL WORKERS. 3 (a) INCREASE IN FUNDING FOR SOCIAL SERVICES 4 BLOCK GRANT PROGRAM.— 5 (1) IN GENERAL.—The amount specified in 6 subsection (c) of section 2003 of the Social Security 7 Act for purposes of subsections (a) and (b) of such 8 VerDate Sep 11 2014 00:08 Apr 17, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H6460.IH H6460 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 6460 IH section is deemed to be $2,550,000,000 for fiscal 1 year 2020, of which $850,000,000 shall be obligated 2 by States during calendar year 2020 in accordance 3 with subsection (b) of this section. 4 (2) APPROPRIATION.—Out of any money in the 5 Treasury of the United States not otherwise appro- 6 priated, there are appropriated $850,000,000 for fis- 7 cal year 2020 to carry out this section. 8 (b) RULES GOVERNING USE OF ADDITIONAL 9 FUNDS.— 10 (1) IN GENERAL.—Funds are used in accord- 11 ance with this subsection if— 12 (A) the funds are used for— 13 (i) child care services for a child of an 14 essential worker; or 15 (ii) daytime care services or other 16 adult protective services for an individual 17 who— 18 (I) is a dependent, or a member 19 of the household of, an essential work- 20 er; and 21 (II) requires the services; 22 (B) the funds are provided to reimburse an 23 essential worker for the cost of obtaining the 24 services (including child care services obtained 25 VerDate Sep 11 2014 00:08 Apr 17, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H6460.IH H6460 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 6460 IH on or after the date the Secretary of Health 1 and Human Services declared a public health 2 emergency pursuant to section 319 of the Pub- 3 lic Health Service Act on January 31, 2020, en- 4 titled ‘‘Determination that a Public Health 5 Emergency Exists Nationwide as the Result of 6 the 2019 Novel Coronavirus’’), to a provider of 7 child care services, or to establish a temporary 8 child care facility operated by a State or local 9 government; 10 (C) eligibility for the funds or services, and 11 the amount of funds or services provided, is not 12 conditioned on a means test; 13 (D) the funds are used subject to the limi- 14 tations in section 2005 of the Social Security 15 Act, except that, for purposes of this subpara- 16 graph— 17 (i) paragraphs (3), (5), and (8) of sec- 18 tion 2005(a) of such Act shall not apply; 19 and 20 (ii)(I) the limitation in section 21 2005(a)(7) of such Act shall not apply 22 with respect to any standard which the 23 State involved determines would impede 24 the ability of the State to provide emer- 25 VerDate Sep 11 2014 00:08 Apr 17, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H6460.IH H6460 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 6460 IH gency temporary care to a child, depend- 1 ent, or household member referred to in 2 subparagraph (A) of this paragraph; and 3 (II) if the State determines that such 4 a standard would be so impeding, the 5 State shall report the determination to the 6 Secretary, separately from the annual re- 7 port to the Secretary by the State; 8 (E) the funds are used to supplement, not 9 supplant, State general revenue funds for child 10 care assistance; and 11 (F) the funds are not used for child care 12 costs that are— 13 (i) covered by funds provided under 14 the Child Care and Development Block 15 Grant Act of 1990 or section 418 of the 16 Social Security Act; or 17 (ii) reimbursable by the Federal 18 Emergency Management Agency. 19 (2) ESSENTIAL WORKER DEFINED.—In para- 20 graph (1), the term ‘‘essential worker’’ means— 21 (A) a health sector employee; 22 (B) an emergency response worker; 23 (C) a sanitation worker; 24 VerDate Sep 11 2014 00:08 Apr 17, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H6460.IH H6460 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 6460 IH (D) a worker at a business which a State 1 or local government official has determined 2 must remain open to serve the public during the 3 emergency referred to in paragraph (1)(B); and 4 (E) any other worker who cannot telework, 5 and whom the State deems to be essential dur- 6 ing the emergency referred to in paragraph 7 (1)(B). 8 Æ VerDate Sep 11 2014 00:08 Apr 17, 2020 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H6460.IH H6460 kjohnson on DSK79L0C42PROD with BILLS
