A BILL
To amend title 5, United States Code, to provide unpaid
leave for certain National Guard service by Federal em-
ployees and employees of the District of Columbia, and
for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Protecting Civil Em-
4
ployment for Our National Guard Act’’.
5
SEC. 2. UNPAID LEAVE FOR STATE ACTIVE DUTY SERVICE.

Section 6323 of title 5, United States Code, is

amended by adding at the end the following:

‘‘(e)(1) An employee as defined by section 2105 or
1
an individual employed by the government of the District
2
of Columbia, permanent or temporary indefinite, who is
3
a member of the National Guard, as described in section
4
101 of title 32, and on State active duty shall be granted
5
leave without pay for each day of such duty.
6
‘‘(2) Any such employee or individual may substitute
7
any annual or sick leave accrued or accumulated by such
8
employee or individual for any leave provided under para-
9
graph (1).

‘‘(3) In this section—
11
‘‘(A) the term ‘State’ means any of the 50
12
States, the District of Columbia, the Commonwealth
13
of Puerto Rico, and a territory of the United States;
14
and
15
‘‘(B) the term ‘State active duty’ means—
16
‘‘(i) duty performed by a member of the
17
National Guard under orders issued by the
18
chief executive of a State in accordance with
19
the laws of that State; and
20
‘‘(ii) does not include duty performed
21
under title 10 or 32.’’.
