A BILL
To amend the Soil and Water Resources Conservation Act
of 1977 with respect to assessments of conservation pro-
grams, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ββFarmer-Driven Con-
4
servation Outcomes Act of 2020ββ.
5
SEC. 2. AMENDMENTS TO THE SOIL AND WATER RE-
6
SOURCES CONSERVATION ACT OF 1977.

The Soil and Water Resources Conservation Act of
8
1977 (16 U.S.C. 2001 et seq.) is amended by redesig-

nating sections 8 through 10 as sections 10 though 12,

respectively, and inserting after section 7 the following:

ββSEC. 8. CONSERVATION PROGRAMS ASSESSMENT.

ββ(a) IN GENERAL.βIn coordination with the ap-
4
praisal of soil, water, and related resources and with the
5
national soil and water conservation program established
6
under this Act, the Secretary may carry out a conservation
7
effects assessment project to quantify the environmental
8
and economic effects of conservation practices, develop the
9
science base for managing the agricultural landscape for
10
environmental quality and sustainable productive capacity,
11
and improve the efficacy of conservation practices and pro-
12
grams by evaluating conservation effects.
13
ββ(b) SCOPE.βThe project under this subsection may
14
be carried out at national, regional, and watershed scales,
15
and may include cropland, grazing lands, wetlands, for-
16
ests, and such other lands as the Secretary may determine
17
appropriate.

ββ(c) ACTIVITIES.βThe project under this subsection
19
may include research, literature reviews and bibliog-
20
raphies, modeling, assessment, monitoring and data collec-
21
tion, outreach, extension education, and such other activi-
22
ties as the Secretary may determine appropriate.

ββ(a) NATURAL RESOURCE
AND ENVIRONMENTAL
3
OBJECTIVES AND OUTCOMES.β
4
ββ(1) IN GENERAL.βIn coordination with the
5
appraisal of soil, water, and related resources, the
6
soil and water conservation program, and the con-
7
servation effects assessment project established by
8
this Act, the Secretary shall identify, and periodi-
9
cally revise, specific natural resource and environ-
10
mental objectives and anticipated conservation out-
11
comes and results, by resource concern, for the con-
12
servation programs established under subtitles D
13
and H of title XII of the Food Security Act of 1985
14
and the landscape conservation initiatives developed
15
by the Secretary.

ββ(2) ASSESSMENTS.βTo help measure out-
17
comes and results, the Secretary shall, to the max-
18
imum extent practicable, make assessments of
19
changes in the status and conditions of natural re-
20
sources and the environment that result from the
21
application of conservation activities supported di-
22
rectly by such conservation programs and initiatives.

ββ(3) MONITORING
AND
PROGRAM
EVALUA-

TION.βThe Secretary shall establish a coordinated
25
monitoring and evaluation process for programs and

initiatives to assess progress toward the identified
1
objectives, to gather information to improve program
2
and initiative implementation in accordance with de-
3
sired program and initiative outcomes and results,
4
and to assess the need for modifications to program
5
or initiative rules or statutes.

ββ(b) MONITORING AND PROGRAM EVALUATION.β

ββ(1) IN GENERAL.βThe Secretary shall use not
8
more than one percent of the total annual funding
9
from the funds of the Commodity Credit Corpora-
10
tion made available for new annual enrollments for
11
the conservation programs established under sub-
12
titles D and H of title XII of the Food Security Act
13
of 1985 to establish a comprehensive monitoring and
14
program evaluation process to assess progress in
15
reaching natural resource and environmental objec-
16
tives identified in accordance with subsection (a) and
17
the contribution of individual programs and initia-
18
tives, as well as the programs and initiatives collec-
19
tively, to that progress.

ββ(2) IMPLEMENTATION.βIn implementing the
21
monitoring and program evaluation process under
22
paragraph (1), the Secretary may consider and in-
23
corporate resource concern inventories, quality cri-
24
teria, conservation practices and enhancements, and

such other information as the Secretary determines
1
relevant for applying the monitoring and program
2
evaluation process across each of the major land
3
uses identified by the Secretary.

ββ(3) MONITORING
AND
EVALUATION
PROC-
5
ESS.β
6
ββ(A) IN
GENERAL.βNot later than two
7
years after the date of enactment of this sec-
8
tion, the Secretary shall issue a design for the
9
comprehensive monitoring and evaluation proc-
10
ess, a schedule for implementing the process,
11
and a plan for coordinating the process with the
12
national soil and water conservation program
13
and conservation effects assessment project es-
14
tablished under this Act.
15
ββ(B) METHODOLOGY.βThe design for the
16
comprehensive monitoring and evaluation proc-
17
ess issued under subparagraph (A) shallβ
18
ββ(i) ensure that data made available
19
to cooperators and researchers under this
20
subsection is transformed into statistical
21
aggregate at the county level, in a form
22
that protects personally identifiable infor-
23
mation; and

ββ(ii) take into account the cumulative
1
nature of conservation over time, the inter-
2
actions and sequencing effects between
3
conservation activities, the differing times
4
for conservation effects to be realized, and
5
other related measurement challenges.

ββ(C) PUBLIC
RESEARCH.βNotwithstand-
7
ing any other provision of law, in order to facili-
8
tate implementation of the monitoring and eval-
9
uation process, the Secretary shall make avail-
10
able conservation activity and program data to
11
cooperators and researchers engaged in public
12
research and evaluation activities to improve
13
conservation outcomes under this subsection,
14
provided thatβ
15
ββ(i) adequate assurances are provided
16
to the Secretary that any resulting re-
17
search or information will be made publicly
18
available and in a form that protects per-
19
sonally identifiable information; and
20
ββ(ii) the National Technical Com-
21
mittee finds that any such research is like-
22
ly to generate information that furthers
23
the purpose of this section.

ββ(4) COOPERATIVE
AGREEMENTS.βThe Sec-
1
retary may implement the monitoring evaluation
2
process in part through cooperative or contribution
3
agreements with Federal, State, and local agencies,
4
universities and colleges, nongovernmental organiza-
5
tions with requisite expertise, as determined by the
6
Secretary in consultation with the National Tech-
7
nical Committee.

ββ(5) NATIONAL TECHNICAL COMMITTEE.β
9
ββ(A) COMPOSITION.βThe monitoring and
10
evaluation process shall be administered by the
11
Natural Resources Conservation Service with
12
assistance from a national technical committee
13
appointed by the Secretary and composed of in-
14
dividuals with relevant technical and scientific
15
expertise representingβ
16
ββ(i) the Agricultural Research Service
17
of the Department of Agriculture;
18
ββ(ii) the Economic Research Service
19
of the Department of Agriculture;
20
ββ(iii) the Farm Service Agency of the
21
Department of Agriculture;
22
ββ(iv) the United States Fish and
23
Wildlife Service;
24
ββ(v) the Forest Service;

and Agriculture;

ββ(vii) the United States Geological
3
Survey;
4
ββ(viii) the Environmental Protection
5
Agency;
6
ββ(ix) State and tribal agencies;
7
ββ(x) land grant university natural re-
8
source research programs;
9
ββ(xi) nongovernmental organizations
10
with expertise in the full array of conserva-
11
tion issues and measurement and evalua-
12
tion of conservation outcomes;
13
ββ(xii) farmers across a variety of geo-
14
graphic regions and production types; and
15
ββ(xiii) such other agencies, institu-
16
tions, or organizations as the Secretary
17
may determine appropriate.

ββ(B) FACA EXEMPTION.βThe national
19
technical committee shall be exempt from the
20
Federal Advisory Committee Act (5 U.S.C.
21
App.).

ββ(C)
TRANSPARENCY.βThe
Secretary
23
shall ensure the proceedings and recommenda-

tions of the national technical committee are
1
available to the public.

ββ(6) VOLUNTARY PARTICIPATION.βIn carrying
3
out this subsection, the Secretary shall ensure that
4
any on-farm monitoring activities that may be in-
5
cluded as part of the monitoring and program eval-
6
uation process are voluntary on the part of the pro-
7
ducer, and may include appropriate compensation,
8
as determined by the Secretary.

ββ(c) REPORTING.β
10
ββ(1) REPORT ON OBJECTIVES AND METHODS.β
11
Beginning in the fiscal year that is 3 years after the
12
date of enactment of this subsection, and periodi-
13
cally thereafter, as determined by the Secretary, the
14
Secretary shall submit to Congress, and make pub-
15
licly available, a report that includesβ
16
ββ(A) a description of conservation outcome
17
objectives that are, to the maximum extent
18
practicable, quantitative, measurable, and time-
19
bound for each program established under sub-
20
title D or H of the Food Security Act of 1985
21
and the landscape conservation initiatives devel-
22
oped by the Secretary;
23
ββ(B) a description of the approaches, tools,
24
and methods used to measure or model the con-

servation outcomes and results and to estimate
1
the cost-effectiveness of each such program; and
2
ββ(C) guidance to the conservation project
3
partners working to implement conservation
4
programs within a landscape-level project that
5
provides a description of the approaches, tools,
6
and methods the partners might consider using
7
to measure and model the conservation out-
8
comes and results of their projects.

ββ(2) REPORT ON OUTCOMES.βIn conjunction
10
with each of the reports to Congress pursuant to
11
section 7, the Secretary shall submit to Congress,
12
and make publicly available, a report that includesβ
13
ββ(A) an assessment of progress made to-
14
wards achieving conservation program objec-
15
tives and anticipated outcomes and results for
16
each conservation program established under
17
subtitle D or H of title XII of the Food Secu-
18
rity Act of 1985, as well as for such programs
19
collectively, and the landscape conservation ini-
20
tiatives developed by the Secretary;
21
ββ(B) an evaluation of the cost-effectiveness
22
of each such conservation program and initia-
23
tive; and

ββ(C) recommendations, in light of the as-
1
sessment and evaluation, to improve program
2
implementation and improve the scientific and
3
economic tools (including any new or revised
4
conservation practices, conservation enhance-
5
ments, or conservation planning tools) used to
6
achieve stated natural resource conservation
7
and environmental objectives.
8
ββ(3) COORDINATION.βThe Secretary may co-
9
ordinate the reports required under paragraphs (1)
10
and (2) with any reports developed as part of the
11
conservation effects assessment project authorized
12
by section 8, whenever such coordination is feasible
13
and warranted, as determined by the Secretary.ββ.
