Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. UPDATING FIRE PREVENTION AND CONTROL 1 GUIDELINES TO REQUIRE MANDATORY IN- 2 STALLATION OF CARBON MONOXIDE ALARMS 3 IN PLACES OF PUBLIC ACCOMMODATION. 4 (a) IN GENERAL.—Section 29(a) of the Federal Fire 5 Prevention and Control Act of 1974 (15 U.S.C. 2225(a)) 6 is amended— 7 (1) in paragraph (1)— 8 (A) by striking ‘‘Standard 74’’ and insert- 9 ing ‘‘Standard 72’’; and 10 (B) by striking ‘‘and’’ after the semicolon; 11 (2) in paragraph (2), by striking the period and 12 inserting ‘‘; and’’; and 13 (3) by adding at the end the following: 14 ‘‘(3) a requirement that compliant carbon mon- 15 oxide alarms shall be installed in each sleeping or 16 dwelling unit within each place of public accommo- 17 dation affecting commerce.’’. 18 (b) DEFINITIONS.—Section 29(d) of the Federal Fire 19 Prevention and Control Act of 1974 (15 U.S.C. 2225(d)) 20 is amended by adding at the end the following: 21 ‘‘(4) The term ‘compliant carbon monoxide 22 alarm’ means a carbon monoxide alarm or detection 23 system installed in accordance with the International 24 Fire Code or National Fire Protection Association 25 VerDate Sep 11 2014 02:21 Mar 12, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H6103.IH H6103 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 6103 IH Standard 72, and the applicable UL standards ref- 1 erenced therein. 2 ‘‘(5) The term ‘National Fire Protection Asso- 3 ciation Standard 72’ refers to the latest edition of 4 the National Fire Alarm and Signaling Code pub- 5 lished by the National Fire Protection Association 6 Standard, or any successor standard relating to the 7 proper installation of carbon monoxide alarms. 8 ‘‘(6) The term ‘International Fire Code’ refers 9 to the latest edition of the International Fire Code 10 published by the International Code Council, or any 11 successor code relating to the proper installation of 12 carbon monoxide alarms.’’. 13 (c) DISSEMINATION OF INFORMATION.—Section 30 14 of the Federal Fire Prevention and Control Act of 1974 15 (15 U.S.C. 2226) is amended in the first sentence— 16 (1) by striking ‘‘and automatic smoke detection 17 systems’’ and inserting ‘‘, automatic smoke detection 18 systems, and compliant carbon monoxide alarms (as 19 defined in section 29(d))’’; and 20 (2) by inserting before the period at the end the 21 following: ‘‘and compliant carbon monoxide alarms’’. 22 (d) UPDATING OF LISTS.—The Administrator of the 23 Federal Emergency Management Agency shall take such 24 steps as may be necessary to ensure that— 25 VerDate Sep 11 2014 02:21 Mar 12, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H6103.IH H6103 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 6103 IH (1) each State updates the list submitted to the 1 Administrator pursuant to subsection (a) of section 2 28 of the Federal Fire Prevention and Control Act 3 of 1974 (15 U.S.C. 2224) to reflect the amendments 4 made by this section; and 5 (2) the master list published under subsection 6 (b) of such section is updated to reflect the changes 7 to the State lists made pursuant to paragraph (1). 8 (e) INTERPRETATION.—Nothing in this Act or the 9 amendments made under this Act shall be construed to 10 prohibit the application of standards with respect to the 11 installation of carbon monoxide alarms or detection sys- 12 tems in places of public accommodation that are higher 13 than the standards under the latest edition of the Inter- 14 national Fire Code or the National Fire Protection Asso- 15 ciation Standard 72, and the applicable UL standards ref- 16 erenced therein. 17 SEC. 3. NOTICE OF COMPLIANT CARBON MONOXIDE 18 ALARMS. 19 (a) IN GENERAL.—The owner or operator of a place 20 of public accommodation affecting commerce (as defined 21 in section 4 of the Federal Fire Prevention and Control 22 Act of 1974 (15 U.S.C. 2203)) shall provide to each guest 23 of such place of public accommodation, upon check-in, 24 written notice attesting that such place of public accom- 25 VerDate Sep 11 2014 02:21 Mar 12, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H6103.IH H6103 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 6103 IH modation is in compliance with the requirement described 1 in section 29(a)(3) of such Act (15 U.S.C. 2225(a)(3)). 2 (b) ENFORCEMENT BY FEDERAL TRADE COMMIS- 3 SION.— 4 (1) UNFAIR OR DECEPTIVE ACTS OR PRAC- 5 TICES.—A violation of subsection (a) or a regulation 6 promulgated under such subsection shall be treated 7 as a violation of a regulation under section 8 18(a)(1)(B) of the Federal Trade Commission Act 9 (15 U.S.C. 57a(a)(1)(B)) regarding unfair or decep- 10 tive acts or practices. 11 (2) POWERS OF COMMISSION.—The Federal 12 Trade Commission shall enforce subsection (a) and 13 the regulations promulgated under such subsection 14 in the same manner, by the same means, and with 15 the same jurisdiction, powers, and duties as though 16 all applicable terms and provisions of the Federal 17 Trade Commission Act (15 U.S.C. 41 et seq.) were 18 incorporated into and made a part of this section. 19 Any person who violates such subsection or a regula- 20 tion promulgated under such subsection shall be 21 subject to the penalties and entitled to the privileges 22 and immunities provided in the Federal Trade Com- 23 mission Act. 24 VerDate Sep 11 2014 02:21 Mar 12, 2020 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H6103.IH H6103 kjohnson on DSK79L0C42PROD with BILLS 6 •HR 6103 IH (3) REGULATIONS.—The Federal Trade Com- 1 mission may promulgate regulations under section 2 553 of title 5, United States Code, to carry out sub- 3 section (a). 4 (c) EFFECTIVE DATE.—This section shall take effect 5 on the date that is 1 year after the date of the enactment 6 of this Act. 7 Æ VerDate Sep 11 2014 02:21 Mar 12, 2020 Jkt 099200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6301 E:\BILLS\H6103.IH H6103 kjohnson on DSK79L0C42PROD with BILLS
