A BILL
To support the reuse and recycling of batteries and critical
minerals, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Battery and Critical
4
Mineral Recycling Act of 2020’’.
5
SEC. 2. DEFINITIONS.
6
In this Act:
7
(1) BATTERY.—The term ‘‘battery’’ means a
8
battery that is—

(A) rechargeable; and

(B) electrochemical, including lithium ion

and other chemistries.

(2) SECRETARY.—The term ‘‘Secretary’’ means
3
the Secretary of Energy.
4
SEC. 3. GRANTS.
5
(a) BATTERY RECYCLING RESEARCH, DEVELOP-
6
MENT, AND DEMONSTRATION GRANTS.—
7
(1) IN GENERAL.—The Secretary shall award
8
multiyear grants to eligible entities for research, de-
9
velopment, and demonstration projects to create in-
10
novative and practical approaches to increase the
11
reuse and recycling of batteries, including by ad-
12
dressing—
13
(A) recycling processes;
14
(B) the development of methods to pro-
15
mote the design and production of batteries
16
that take into full account and facilitate the
17
dismantling, reuse, recovery, and recycling of
18
battery components and materials;
19
(C) strategies to increase consumer accept-
20
ance of, and participation in, the recycling of
21
batteries; and
22
(D) the integration of increased quantities
23
of recycled critical minerals in batteries and

other products to develop markets for recycled
1
battery materials and critical minerals.
2
(2) ELIGIBLE ENTITIES.—The Secretary may
3
award a grant under paragraph (1) to—
4
(A) an institution of higher education;
5
(B) a National Laboratory;
6
(C) a Federal research agency;
7
(D) a State research agency;
8
(E) a nonprofit organization;
9
(F) an industrial entity;
10
(G) a manufacturing entity;
11
(H) a private battery-collection entity;
12
(I) a State or municipal government entity;
13
(J) a battery retailer; or
14
(K) a consortium of 2 or more entities de-
15
scribed in subparagraphs (A) through (J).
16
(3) APPLICATIONS.—
17
(A) IN GENERAL.—To be eligible to receive
18
a grant under paragraph (1), an eligible entity
19
described in paragraph (2) shall submit to the
20
Secretary an application at such time, in such
21
manner, and containing such information as the
22
Secretary may require.

(B) CONTENTS.—An application submitted
1
under subparagraph (A) shall describe how the
2
project will promote collaboration among—
3
(i) vehicle battery manufacturers;
4
(ii) other battery manufacturers;
5
(iii) battery material and equipment
6
manufacturers;
7
(iv) battery recyclers, collectors, and
8
refiners; and
9
(v) retailers.
10
(b) STATE AND LOCAL PROGRAMS.—
11
(1) IN GENERAL.—The Secretary shall establish
12
a program under which the Secretary shall award
13
grants, on a competitive basis, to States and units
14
of local government to assist in the establishment or
15
enhancement of State battery collection, recycling,
16
and reprocessing programs.
17
(2) NON-FEDERAL
COST
SHARE.—The non-
18
Federal share of the cost of a project carried out
19
using a grant under this subsection shall be 50 per-
20
cent of the cost of the project.
21
(3) REPORT.—Not later than 2 years after the
22
date of enactment of this Act, and annually there-
23
after, the Secretary shall submit to Congress a re-
24
port that describes the number of battery collection

points established or enhanced, an estimate of jobs
1
created, and the quantity of material collected as a
2
result of the grants awarded under paragraph (1).

(c) RETAILERS AS COLLECTION POINTS.—
4
(1) IN GENERAL.—The Secretary shall award
5
grants, on a competitive basis, to retailers that sell
6
batteries to establish and implement a system for
7
the acceptance and collection of used batteries for
8
reuse, recycling, or proper disposal.
9
(2) COLLECTION
SYSTEM.—The system de-
10
scribed in paragraph (1) shall include take-back of
11
used batteries at no cost to the consumer.
12
SEC. 4. LITHIUM-ION BATTERY RECYCLING PRIZE COM-
13
PETITION.
14
(a) IN GENERAL.—The Secretary shall continue to
15
carry out the existing Lithium-Ion Battery Recycling
16
Prize competition of the Department of Energy estab-
17
lished under section 24 of the Stevenson-Wydler Tech-
18
nology Innovation Act of 1980 (15 U.S.C. 3719).
19
(b) ADDITIONAL FUNDING FOR PILOT PROJECTS.—
20
In addition to any other funds made available to the Sec-
21
retary to carry out the competition described in subsection
22
(a), there is authorized to be appropriated to the Secretary
23
to carry out Phase III of that competition $10,000,000

for fiscal year 2021, to remain available until expended,
1
which the Secretary may use—
2
(1) to increase the number of winners of Phase
3
III of that competition;
4
(2) to increase the amount awarded to the win-
5
ners of Phase III of that competition; or
6
(3) to carry out any other activity that is con-
7
sistent with the goals of Phase III of that competi-
8
tion, as determined by the Secretary.

SEC. 5. BEST PRACTICES FOR COLLECTION OF BATTERIES.

(a) IN GENERAL.—The Administrator of the Envi-
11
ronmental Protection Agency (referred to in this section
12
as the ‘‘Administrator’’) shall develop best practices for
13
the collection of batteries that may be cost-effectively im-
14
plemented by States and units of local government.
15
(b) COORDINATION.—The Administrator shall de-
16
velop best practices under subsection (a) in coordination
17
with State and local leaders and entities in relevant pri-
18
vate sectors.
19
(c) REPORT.—Not later than 1 year after the date
20
of enactment of this Act, the Administrator shall submit
21
to Congress a report describing the best practices devel-
22
oped under this section.

SEC. 6. VOLUNTARY LABELING PROGRAM.
1
(a) IN GENERAL.—There is established within the
2
Department of Energy and the Environmental Protection
3
Agency a voluntary program to promote battery recycling
4
and identify collection points in order to reduce battery
5
waste, improve collection, and reduce safety concerns
6
through—
7
(1) voluntary labeling of batteries; or
8
(2) other forms of communication about the
9
reuse and recycling of critical materials from bat-
10
teries.
11
(b) DIVISION
OF RESPONSIBILITIES.—Responsibil-
12
ities under the program established by subsection (a) shall
13
be divided between the Secretary and the Administrator
14
of the Environmental Protection Agency (referred to in
15
this section as the ‘‘Administrator’’) in accordance with
16
the terms of applicable agreements between the Secretary
17
and the Administrator.
18
SEC. 7. TASK FORCE ON PRODUCER REQUIREMENTS.
19
(a) IN GENERAL.—The Secretary shall convene a
20
task force to develop an extended battery producer respon-
21
sibility framework that—
22
(1) addresses battery recycling goals, cost struc-
23
tures for mandatory recycling, reporting require-
24
ments, product design, collection models, and trans-
25
portation of collected materials;

(2) provides sufficient flexibility to allow battery
1
producers to determine cost-effective strategies for
2
compliance with the framework; and
3
(3) outlines regulatory pathways for effective
4
recycling.

(b) TASK FORCE PARTICIPANTS.—The task force
6
convened under subsection (a) shall include—
7
(1) battery producers, retailers, recyclers, col-
8
lectors, and refiners;
9
(2) States and municipalities; and
10
(3) other relevant stakeholders, as determined
11
by the Secretary.

(c) REPORT.—Not later than 1 year after the date
13
on which the Secretary convenes the task force under sub-
14
section (a), the Secretary shall submit to Congress a re-
15
port that—
16
(1) describes the extended producer responsi-
17
bility framework developed by the task force;
18
(2) includes the recommendations of the task
19
force on how best to implement a mandatory pay-in
20
or other enforcement mechanism to ensure battery
21
producers and sellers are contributing to the recy-
22
cling of batteries; and
23
(3) suggests regulatory pathways for effective
24
recycling.

SEC. 8. AUTHORIZATION OF APPROPRIATIONS.
1
There is authorized to be appropriated to carry out
2
this Act $30,000,000 for each of fiscal years 2021 through
3
2025.
