A BILL
To amend title 5, United States Code, to provide for the
halt in pension payments for Members of Congress sen-
tenced for certain offenses, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘No Congressionally-
4
Obligated Recurring Revenue Used as Pensions To Incar-

SEC. 2. FORFEITURE OF PENSION.

(a) IN GENERAL.—Section 8332(o) of title 5, United
4
States Code, is amended—
5
(1) by redesignating paragraphs (4), (5), and
6
(6) as paragraphs (5), (6), and (7), respectively;
7
(2) by inserting after paragraph (3) the fol-
8
lowing:
9
‘‘(4)(A) Subject to subparagraph (B), an individual
10
convicted of an offense described in paragraph (2) shall
11
not be eligible to receive any payment of an annuity pursu-
12
ant to the retirement system under this subchapter or
13
chapter 84, except that this sentence applies only to such
14
payments based on service rendered as a Member (irre-
15
spective of when rendered).

‘‘(B) If the conviction of an individual described in
17
subparagraph (A) is held to be invalid, the individual shall
18
receive payments that the individual would have received
19
but for the application of subparagraph (A).
20
‘‘(C) This paragraph applies only to a conviction that
21
occurs after the date of enactment of this paragraph.’’;
22
(3) in paragraph (5)(B)(i), as so redesignated,
23
by striking ‘‘paragraph (5)’’ and inserting ‘‘para-
24
graph (6)’’; and

amended by striking ‘‘section 8332(o)(5)’’ and inserting

‘‘section 8332(o)(6)’’.
