To amend chapter 44 of title 18, United States Code, to provide that a
member of the Armed Forces and the spouse of that member shall
have the same rights regarding the receipt of firearms at the location
of any duty station of the member.

A BILL
To amend chapter 44 of title 18, United States Code, to
provide that a member of the Armed Forces and the
spouse of that member shall have the same rights regard-
ing the receipt of firearms at the location of any duty
station of the member.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Protect Our Military
4
Families’ 2nd Amendment Rights Act’’.

SEC. 2. RECEIPT OF FIREARM OR AMMUNITION BY SPOUSE
1
OF MEMBER OF THE ARMED FORCES AT A
2
DUTY STATION OF THE MEMBER OUTSIDE
3
THE UNITED STATES.

Section 925(a)(3) of title 18, United States Code, is
5
amended—
6
(1) by inserting ‘‘or to the spouse of such a
7
member’’ before ‘‘or to’’;
8
(2) by striking ‘‘members,’’ and inserting
9
‘‘members and spouses,’’;
10
(3) by striking ‘‘members or’’ and inserting
11
‘‘members, spouses, or’’; and
12
(4) by striking ‘‘member or’’ and inserting
13
‘‘member, spouse, or’’.

SEC. 3. RESIDENCY OF SPOUSES OF MEMBERS OF THE
15
ARMED FORCES TO BE DETERMINED ON THE
16
SAME BASIS AS THE RESIDENCY OF SUCH
17
MEMBERS FOR PURPOSES OF FEDERAL FIRE-
18
ARMS LAWS.

Section 921(b) of title 18, United States Code, is
20
amended to read as follows:

‘‘(b) For purposes of this chapter, a member of the
22
Armed Forces on active duty, or a spouse of such a mem-
23
ber, is a resident of—
24
‘‘(1) the State in which the member or spouse
25
maintains legal residence;

‘‘(2) the State in which the permanent duty

station of the member is located; and
2
‘‘(3) the State in which the member maintains
3
a place of abode from which the member commutes
4
each day to the permanent duty station of the mem-
5
ber.’’.

SEC. 4. EFFECTIVE DATE.
7
The amendments made by this Act shall apply to con-
8
duct engaged in after the 6-month period that begins with
9
the date of the enactment of this Act.
