Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. PROTECTION AGAINST POTENTIAL SYNTHETIC 1 OPIOID EXPOSURE WITHIN U.S. CUSTOMS 2 AND BORDER PROTECTION. 3 (a) IN GENERAL.—Subtitle B of title IV of the 4 Homeland Security Act of 2002 (6 U.S.C. 211 et seq.) 5 is amended by inserting after section 415 the following 6 new section: 7 ‘‘SEC. 416. PROTECTION AGAINST POTENTIAL SYNTHETIC 8 OPIOID EXPOSURE. 9 ‘‘(a) IN GENERAL.—The Commissioner of U.S. Cus- 10 toms and Border Protection shall issue a policy that speci- 11 fies effective protocols and procedures for the safe han- 12 dling of potential synthetic opioids, including fentanyl, by 13 U.S. Customs and Border Protection officers, agents, 14 other personnel, and canines, and to reduce the risk of 15 injury or death resulting from accidental exposure and en- 16 hance post-exposure management. 17 ‘‘(b) TRAINING.— 18 ‘‘(1) IN GENERAL.—Together with the issuance 19 of the policy described in subsection (a), the Com- 20 missioner of U.S. Customs and Border Protection 21 shall require mandatory and recurrent training on 22 the following: 23 ‘‘(A) The potential risk of opioid exposure 24 and safe handling procedures for potential syn- 25 thetic opioids, including precautionary measures 26 VerDate Sep 11 2014 04:14 Feb 28, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S3345.IS S3345 kjohnson on DSK79L0C42PROD with BILLS 3 •S 3345 IS such as the use of personal protective equip- 1 ment during such handling. 2 ‘‘(B) How to access and administer opioid 3 receptor antagonists, including naloxone, post- 4 exposure to potential synthetic opioids. 5 ‘‘(2) INTEGRATION.—The training described in 6 paragraph (1) may be integrated into existing train- 7 ing under section 411(l) for U.S. Customs and Bor- 8 der Protection officers, agents, and other personnel. 9 ‘‘(c) PERSONAL PROTECTIVE EQUIPMENT AND 10 OPIOID RECEPTOR ANTAGONISTS.—Together with the 11 issuance of the policy described in subsection (a), the 12 Commissioner of U.S. Customs and Border Protection 13 shall ensure the availability of personal protective equip- 14 ment and opioid receptor antagonists, including naloxone, 15 to all U.S. Customs and Border Protection officers, 16 agents, other personnel, and canines at risk of accidental 17 exposure to synthetic opioids. 18 ‘‘(d) OVERSIGHT.—To ensure effectiveness of the pol- 19 icy described in subsection (a)— 20 ‘‘(1) the Commissioner of U.S. Customs and 21 Border Protection shall regularly monitor the effi- 22 cacy of the implementation of such policy and adjust 23 protocols and procedures, as necessary; and 24 VerDate Sep 11 2014 04:14 Feb 28, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S3345.IS S3345 kjohnson on DSK79L0C42PROD with BILLS 4 •S 3345 IS ‘‘(2) the Inspector General of the Department 1 shall audit compliance with the requirements of this 2 section not less than once during the 3-year period 3 after the date of the enactment of this section.’’. 4 (b) CLERICAL AMENDMENT.—The table of contents 5 in section 1(b) of the Homeland Security Act of 2002 is 6 amended by inserting after the item relating to section 7 415 the following new item: 8 ‘‘Sec. 416. Protection against potential synthetic opioid exposure.’’.
