IN THE SENATE OF THE UNITED STATES JANUARY 21, 2020 Mr. MCCONNELL submitted the following resolution JANUARY 22 (legislative day, JANUARY 21), 2020 Considered and agreed to RESOLUTION To provide for related procedures concerning the articles of impeachment against Donald John Trump, President of the United States. Resolved, That the House of Representatives shall file 1 its record with the Secretary of the Senate, which will con- 2 sist of those publicly available materials that have been 3 submitted to or produced by the House Judiciary Com- 4 mittee, including transcripts of public hearings or mark- 5 ups and any materials printed by the House of Represent- 6 atives or the House Judiciary Committee pursuant to 7 House Resolution 660. All materials filed 2 pursuant to this paragraph shall be printed and made 3 available to all parties. 4 The President and the House of Representatives shall 5 have until 9:00 a.m. on Wednesday, January 22, 2020, 6 to file any motions permitted under the rules of impeach- 7 ment with the exception of motions to subpoena witnesses 8 or documents or any other evidentiary motions. Responses 9 to any such motions shall be filed no later than 11:00 a.m. 10 on Wednesday, January 22, 2020. All materials filed pur- 11 suant to this paragraph shall be filed with the Secretary 12 and be printed and made available to all parties. 13 Arguments on such motions shall begin at 1:00 p.m. 14 on Wednesday, January 22, 2020, and each side may de- 15 termine the number of persons to make its presentation, 16 following which the Senate shall deliberate, if so ordered 17 under the impeachment rules, and vote on any such mo- 18 tions. 19 Following the disposition of such motions, or if no 20 motions are made, then the House of Representatives shall 21 make its presentation in support of the articles of im- 22 peachment for a period of time not to exceed 24 hours, 23 over up to 3 session days. Each side may determine the number 2 of persons to make its presentation. 3 Upon the conclusion of the President’s presentation, 4 Senators may question the parties for a period of time 5 not to exceed 16 hours. 6 Upon the conclusion of questioning by the Senate, 7 there shall be 4 hours of argument by the parties, equally 8 divided, followed by deliberation by the Senate, if so or- 9 dered under the impeachment rules, on the question of 10 whether it shall be in order to consider and debate under 11 the impeachment rules any motion to subpoena witnesses 12 or documents. The Senate, without any intervening action, 13 motion, or amendment, shall then decide by the yeas and 14 nays whether it shall be in order to consider and debate 15 under the impeachment rules any motion to subpoena wit- 16 nesses or documents. 17 Following the disposition of that question, other mo- 18 tions provided under the impeachment rules shall be in 19 order. 20 If the Senate agrees to allow either the House of Rep- 21 resentatives or the President to subpoena witnesses, the 22 witnesses shall first be deposed and the Senate shall decide 23 after deposition which witnesses shall testify, pursuant to 24 the impeachment rules.
