A BILL
To amend the Endangered Species Act of 1973 to add re-
quirements to the designation of areas as critical habi-
tats, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Critical Habitat Im-
4
provement Act’’.

SEC. 2. REQUIREMENTS FOR CRITICAL HABITAT DESIGNA-

TION.

(a) DEFINITION
OF CRITICAL HABITAT.—Section
3
3(5) of the Endangered Species Act of 1973 (16 U.S.C.
4
1532(5)) is amended—
5
(1) by amending subparagraph (A) to read as
6
follows:
7
‘‘(A) The term ‘critical habitat’ for a
8
threatened
species
or
endangered
species
9
means—
10
‘‘(i) the specific areas of habitat with-
11
in the geographical area occupied by the
12
species, at the time such species is listed in
13
accordance with the provisions of section 4
14
of this Act, that the Secretary determines
15
have physical or biological features that—
16
‘‘(I) are essential to the conserva-
17
tion of such species; and
18
‘‘(II) may require special man-
19
agement consideration or protection;
20
or
21
‘‘(ii) the specific areas of habitat out-
22
side the geographical area occupied by the
23
species, at the time such species is listed in
24
accordance with the provisions of section 4

of this Act, that the Secretary deter-

mines—
2
‘‘(I) are essential for the contin-
3
ued survival of such species;
4
‘‘(II) are able to sustain occu-
5
pancy by such species at the time of
6
the determination described in this
7
clause; and
8
‘‘(III) have physical or biological
9
features that—
10
‘‘(aa) are essential to the
11
conservation of such species; and
12
‘‘(bb) may require special
13
management
consideration
or
14
protection.’’; and
15
(2) by adding at the end the following:
16
‘‘(D) IDENTIFICATION OF FEATURES.—In mak-
17
ing a critical habitat designation under section
18
4(a)(3)(A)(i), the Secretary shall identify with speci-
19
ficity the constituent elements of any physical or bio-
20
logical features that form the basis for such designa-
21
tion.’’.

(b) PRIORITY FOR DESIGNATING CRITICAL HABI-
23
TAT.—Section 4(a)(3) is amended at the end by adding
24
the following:

‘‘(C) PRIORITY
FOR
DESIGNATING
CRIT-

ICAL HABITAT.—The Secretary may not des-
2
ignate habitat outside the geographical area oc-
3
cupied by the species as critical habitat unless
4
such designation is necessary to ensure the con-
5
tinued survival of such species.’’.
