PERMITTING COMMERCIAL FILMMAKING AND 3 PHOTOGRAPHY ON UNITED STATES CAPITOL 4 GROUNDS. 5 (a) IN GENERAL.—Section 5106 of title 40, United 6 States Code, is amended by adding at the end the fol- 7 lowing new subsection: 8 VerDate Sep 11 2014 19:09 Dec 29, 2019 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H5521.IH H5521 pamtmann on DSKBC07HB2PROD with BILLS 2 •HR 5521 IH ‘‘(d) COMMERCIAL FILMMAKING AND PHOTOG- 1 RAPHY.— 2 ‘‘(1) AUTHORIZATION BY CAPITOL POLICE.— 3 Notwithstanding section 5104(c) or any other provi- 4 sion of this chapter which restricts commercial activ- 5 ity on the United States Capitol Grounds, the Chief 6 of the United States Capitol Police (hereafter in this 7 subsection referred to as the ‘Chief’)— 8 ‘‘(A) may issue a permit authorizing a per- 9 son to engage in appropriate commercial 10 filmmaking and photography activity on the 11 United States Capitol Grounds (other than any 12 Capitol Buildings described in section 5101), so 13 long as the person only engages in such activity 14 on a day on which neither House of Congress 15 is in session; and 16 ‘‘(B) under the terms and conditions of 17 such a permit, may require the person to whom 18 the permit is issued to pay an appropriate fee 19 to cover any costs incurred by the Architect of 20 the Capitol as a result of the issuance of the 21 permit. 22 ‘‘(2) TYPES OF ACTIVITIES AND FEES PER- 23 MITTED.—For purposes of paragraph (1)— 24 VerDate Sep 11 2014 19:09 Dec 29, 2019 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H5521.IH H5521 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 5521 IH ‘‘(A) commercial filmmaking and photog- 1 raphy activity shall be considered appropriate 2 only if the activity is similar to the types of 3 commercial activity permitted in Union Square 4 prior to the transfer of jurisdiction and control 5 of Union Square to the Architect of the Capitol 6 under section 1202 of the Legislative Branch 7 Appropriations Act, 2012 (2 U.S.C. 1811 note); 8 and 9 ‘‘(B) a fee shall be considered appropriate 10 only if the fee is similar to the fee collected by 11 the Director of the National Park Service for 12 commercial activity permitted in Union Square 13 prior to such transfer of jurisdiction and con- 14 trol. 15 ‘‘(3) USE OF FEES.—Immediately upon receiv- 16 ing any fees collected under paragraph (1)(B), the 17 Chief shall transfer the fees to the Capitol Trust Ac- 18 count established under section 213(c) of the Legis- 19 lative Branch Appropriations Act, 2014 (40 U.S.C. 20 5102 note). 21 ‘‘(4) REGULATIONS.—The Chief shall carry out 22 this subsection in accordance with such regulations 23 as the Capitol Police Board may promulgate pursu- 24 ant to the Board’s authority under section 14 of the 25 VerDate Sep 11 2014 19:09 Dec 29, 2019 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H5521.IH H5521 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 5521 IH Act of July 31, 1946 (2 U.S.C. 1969), except that 1 the Board shall promulgate the regulations in con- 2 sultation with the Committee on House Administra- 3 tion of the House of Representatives and the Com- 4 mittee on Rules and Administration of the Senate. 5 ‘‘(5) UNION SQUARE DEFINED.—In this sub- 6 section, the term ‘Union Square’ means the area for 7 which jurisdiction and control was transferred to the 8 Architect of the Capitol under section 1202 of the 9 Legislative Branch Appropriations Act, 2012 (2 10 U.S.C. 1811 note).’’. 11 (b) CONFORMING AMENDMENT RELATING TO CAP- 12 ITOL TRUST ACCOUNT.—Section 213(c) of the Legislative 13 Branch Appropriations Act, 2014 (40 U.S.C. 5102 note) 14 is amended by striking ‘‘subsection (b)(2)’’ each place it 15 appears and inserting ‘‘subsection (b)(2) or section 16 5106(d) of title 40, United States Code’’. 17 Æ VerDate Sep 11 2014 19:09 Dec 29, 2019 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H5521.IH H5521 pamtmann on DSKBC07HB2PROD with BILLS
