A BILL
To require the Secretary of the Interior to establish a pilot
program for commercial recreation concessions on certain
land managed by the Bureau of Land Management.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘RPPA Commercial
4
Recreation Concessions Pilot Program Act of 2019’’.

SEC. 2. COMMERCIAL RECREATION CONCESSIONS PILOT

PROGRAM.

The Act of June 14, 1926 (commonly known as the
8
‘‘Recreation and Public Purposes Act’’) (44 Stat. 741,

‘‘SEC. 7. COMMERCIAL RECREATION CONCESSIONS PILOT
3
PROGRAM.
4
‘‘(a) IN GENERAL.—Notwithstanding any other pro-
5
vision of this Act (including any regulations under this
6
Act), not later than 90 days after the date of enactment
7
of this section, the Secretary shall establish a pilot pro-
8
gram to authorize commercial recreation concessions on
9
land patented or leased under this Act.

‘‘(b) CONCESSIONS AGREEMENTS.—
11
‘‘(1) IN GENERAL.—In carrying out the pilot
12
program established under subsection (a), the Sec-
13
retary shall enter into not more than 10 agreements
14
with parties to whom the land described in sub-
15
section (a) has been patented or leased for the estab-
16
lishment of commercial recreation concessions on the
17
land covered by the agreement.

‘‘(2) TERM.—
19
‘‘(A) IN GENERAL.—An agreement entered
20
into under paragraph (1) shall be for a period
21
that is consistent with the period of time re-
22
quired to amortize the capital investment made
23
under the agreement but in any case not longer
24
than 20 years.

‘‘(B) EXTENSION.—On a finding of satis-
1
factory performance, the Secretary may extend
2
the term of an agreement for 1 additional pe-
3
riod equal in length to the initial term.

‘‘(3) THIRD-PARTY AGREEMENTS.—
5
‘‘(A) IN GENERAL.—A party to an agree-
6
ment entered into under paragraph (1) may
7
enter into agreements with third parties for the
8
establishment of commercial recreation conces-
9
sions pursuant to the agreement entered into
10
under paragraph (1).

‘‘(B) TERM.—An agreement entered into
12
under subparagraph (A) shall not be for a pe-
13
riod that is longer than the term of the agree-
14
ment entered into under paragraph (1).
15
‘‘(c) USE OF FUNDS.—A party to an agreement en-
16
tered into under subsection (b)(1) shall not be required
17
to use revenue collected pursuant to the commercial recre-
18
ation concessions on the land covered by the agreement.
19
‘‘(d) AUTHORIZED ACTIVITIES.—For the term of an
20
agreement entered into under subsection (b)(1), with re-
21
spect to land covered by the agreement, any activity de-
22
fined as permissible under parts 2920 and 2930 of title
23
43, Code of Federal Regulations (or successor regula-
24
tions), shall be permissible.

‘‘(e) EFFECT.—The establishment of commercial
1
recreation concessions under subsection (b) shall not be
2
considered to be a change in use for purposes of this Act.’’.
