To amend title XVIII of the Social Security Act to count toward the deter-
mination of full time equivalency for graduate medical education under
the Medicare program time spent in an approved medical residency
training program for training in culturally and linguistically appropriate
care.

Ms. MUCARSEL-POWELL (for herself and Ms. PORTER) introduced the fol-
lowing bill; which was referred to the Committee on Ways and Means,
and in addition to the Committee on Energy and Commerce, for a period
to be subsequently determined by the Speaker, in each case for consider-
ation of such provisions as fall within the jurisdiction of the committee
concerned
A BILL
To amend title XVIII of the Social Security Act to count
toward the determination of full time equivalency for
graduate medical education under the Medicare program
time spent in an approved medical residency training
program for training in culturally and linguistically ap-
propriate care.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Medical Education for

a Diverse America Act’’.

SEC. 2. TRAINING TOMORROW’S DOCTORS FOR CUL-

TURALLY
AND
LINGUISTICALLY
APPRO-

PRIATE CARE: GRADUATE MEDICAL EDU-

CATION.

(a) DIRECT GME.—Section 1886(h)(4) of the Social
8
Security Act (42 U.S.C. 22 1395ww(h)(4)) is amended by
9
adding at the end the following new subparagraph :

‘‘(L) TREATMENT
OF
CULTURAL
COM-
11
PETENCY
TRAINING.—In determining a hos-
12
pital’s number of full-time equivalent residents
13
for purposes of this subsection, all the time that
14
is spent by an intern or resident in an approved
15
medical residency training program for edu-
16
cation and training in cultural competency and
17
linguistically appropriate service delivery shall
18
be counted toward the determination of full
19
time equivalency.’’.

INDIRECT
MEDICAL
EDUCATION.—Section
21
1886(d)(5)(B) of the Social Security Act (42 U.S.C.
22
1395ww(d)(5)(B)) is amended—
23
(1) by redesignating the clause (x) added by
24
section 5505(b) of the Patient Protection and Af-
25
fordable Care Act as clause (xi); and

(2) by adding at the end the following new

clause:

‘‘(xii) The provisions of subparagraph
3
(L) of subsection (h)(4) shall apply under
4
this subparagraph in the same manner as
5
they apply under such subsection.’’.

(c) EFFECTIVE DATE.—The amendments made by
7
subsections (a) and (b) shall apply with respect to pay-
8
ments made to hospitals on or after the date that is one
9
year after the date of the enactment of this Act.
