SHORT TITLE. 3 This Act may be cited as the ‘‘Telemental Health Ex- 4 pansion Act of 2020’’. 5 SEC. 2. EXPANDING THE USE OF TELEHEALTH FOR CER- 6 TAIN MENTAL HEALTH SERVICES. 7 (a) IN GENERAL.—Section 1834(m)(7) of the Social 8 Security Act (42 U.S.C.1395m(m)(7)) is amended— 9 (1) in the heading, by inserting ‘‘AND CERTAIN 10 MENTAL HEALTH SERVICES’’ after ‘‘DISORDER SERV- 11 ICES’’; and 12 (2) by inserting ‘‘or on or after the emergency 13 period described in section 1135(g)(1)(B), to an eligi- 14 ble telehealth individual for purposes of diagnosis, 15 evaluation, or treatment of a mental health disorder, 16 as determined by the Secretary,’’ after ‘‘as determined 17 by the Secretary,’’. 18 (b) IMPLEMENTATION.—Notwithstanding any other 19 provision of law, the Secretary of Health and Human Serv- 20 ices may implement the amendments made by this section 21 by interim final rule, program instruction, or otherwise. 22 VerDate Sep 11 2014 18:13 Dec 26, 2020 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6203 E:\BILLS\H5201.RH H5201 pbinns on DSKJLVW7X2PROD with BILLS Union Calendar No. 580 116TH CONGRESS 2D SESSION H.
