SHORT TITLE. 1 This Act may be cited as the ‘‘GI Bill Planning Act 2 of 2019’’. 3 SEC. 2. PERIOD FOR ELECTION TO RECEIVE BENEFITS 4 UNDER ALL-VOLUNTEER EDUCATIONAL AS- 5 SISTANCE PROGRAM OF DEPARTMENT OF 6 VETERANS AFFAIRS. 7 (a) IN GENERAL.—Section 3011 of title 38, United 8 States Code, is amended— 9 (1) in subsection (c)(1), by striking ‘‘Any such 10 election shall be made at the time the individual ini- 11 tially enters on active duty as a member of the 12 Armed Forces’’ and inserting ‘‘Any such election 13 shall be made during the 90-day period beginning on 14 the day that is 180 days after the date on which the 15 individual initially enters initial training’’; and 16 (2) in subsection (b)(1), by striking ‘‘that such 17 individual is entitled to such pay’’ and inserting 18 ‘‘that begin after the date that is 270 days after the 19 date on which the individual initially enters initial 20 training’’. 21 (b) EFFECTIVE DATE.—The amendments made by 22 subsection (a) shall take effect 180 days after the date 23 of enactment of this Act. 24 VerDate Sep 11 2014 23:40 Dec 06, 2019 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H5278.IH H5278 kjohnson on DSK79L0C42 with BILLS 3 •HR 5278 IH SEC. 3. PHASE OUT OF ALL-VOLUNTEER EDUCATIONAL AS- 1 SISTANCE PROGRAM. 2 Subsection (a)(1)(A) of section 3011 of title 38, 3 United States Code, as amended by section 1, is further 4 amended by striking ‘‘after June 30, 1985’’ and inserting 5 ‘‘during the period beginning July 1, 1985, and ending 6 September 30, 2029’’. 7 SEC. 4. REQUIREMENTS FOR IN-STATE TUITION. 8 (a) IN GENERAL.—Section 3679(c) of title 38, 9 United States Code, is amended— 10 (1) in paragraph (2)(A), by striking ‘‘less than 11 three years before the date of enrollment in the 12 course concerned’’; and 13 (2) in paragraph (4)— 14 (A) by striking ‘‘It shall’’ and inserting 15 ‘‘(A) It shall’’; and 16 (B) by adding at the end the following new 17 subparagraph: 18 ‘‘(B) To the extent feasible, the Secretary shall make 19 publicly available on the internet website of the Depart- 20 ment a database explaining any requirements described in 21 subparagraph (A) that are established by a public institu- 22 tion of higher learning for an individual to be charged tui- 23 tion and fees at a rate that is equal to or less than the 24 rate the institution charges for tuition and fees for resi- 25 dents of the State in which the institution is located. The 26 VerDate Sep 11 2014 23:40 Dec 06, 2019 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H5278.IH H5278 kjohnson on DSK79L0C42 with BILLS 4 •HR 5278 IH Secretary shall disapprove a course of education provided 1 by such an institution that does not provide the Sec- 2 retary— 3 ‘‘(i) an initial explanation of such requirements; 4 and 5 ‘‘(ii) not later than 90 days after the date on 6 which any such requirements change, the updated 7 requirements.’’. 8 (b) APPLICATION.—The amendments made by this 9 section shall apply with respect to a quarter, semester, or 10 term, as applicable, commencing on or after August 1, 11 2020. 12 SEC. 5.
