A BILL
To direct the Attorney General to make grants to States
that have in place a law providing for the rights of
sexual assault survivors, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Survivors’ Bill of
4
Rights in the States Act of 2019’’.
5
SEC. 2. INCENTIVES FOR STATES TO CREATE SEXUAL AS-
6
SAULT SURVIVORS’ BILL OF RIGHTS.

(a) IN GENERAL.—The Attorney General shall make
8
grants to States that have in place a law that provides

to sexual assault survivors the rights, at a minimum,
1
under section 3772 of title 18, United States Code.

(b) GRANT AMOUNT.—Subject to the availability of
3
appropriations, a grant to a State under this section shall
4
be equal to 10 percent of the average of the amount of
5
funding of the 3 most recent awards that the State re-
6
ceived under part T of title I of the Omnibus Crime Con-
7
trol and Safe Streets Act of 1968 (34 U.S.C. 10441 et
8
seq.) (commonly referred to as the ‘‘STOP Violence
9
Against Women Formula Grant Program’’).

(c) APPLICATION.—A State seeking a grant under
11
this section shall submit an application to the Attorney
12
General at such time, in such manner, and containing
13
such information as the Attorney General may reasonably
14
require, including information about the law described in
15
subsection (a).

(d) USES OF FUNDS.—A State receiving a grant
17
under this section may use such funds to—
18
(1) implement the rights provided for under the
19
law described in subsection (a);
20
(2) preserve sexual assault evidence collection
21
kits or the probative contents of such kits;
22
(3) reduce the number of backlogged sexual as-
23
sault kits or stored kits which victims have con-
24
sented to test; or

(4) provide assistance to victim service pro-

viders, victim assistants, and victim advocates to
2
provide victim services (as such terms are defined in
3
section 40002 of the Violence Against Women Act of
4
1994 (34 U.S.C. 12291)).

(e) AUTHORIZATION OF APPROPRIATIONS.—There is
6
authorized to be appropriated $20,000,000 for each of fis-
7
cal years 2021 through 2025 to carry out this section.
