AN ACT
To require the Department of Homeland Security to prepare
a terrorism threat assessment relating to unmanned air-
craft systems, and for other purposes.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Protecting Critical In-
2
frastructure Against Drones and Emerging Threats Act’’.
3
SEC. 2. DRONE AND EMERGING THREAT ASSESSMENT.

(a) IN GENERAL.—Not later than 120 days after the
5
date of enactment of this Act, the Under Secretary for
6
Intelligence and Analysis of the Department of Homeland
7
Security shall—
8
(1) in consultation with other relevant officials
9
of the Department, request additional information
10
from other agencies of the Federal Government,
11
State and local government agencies, and the private
12
sector relating to threats of unmanned aircraft sys-
13
tems and other emerging threats associated with
14
such new technologies;
15
(2) in consultation with relevant officials of the
16
Department and other appropriate agencies of the
17
Federal Government, develop and disseminate a se-
18
curity threat assessment regarding unmanned air-
19
craft systems and other emerging threats associated
20
with such new technologies; and
21
(3) establish and utilize, in conjunction with the
22
Chief Information Officer of the Department and
23
other relevant entities, a secure communications and
24
information technology infrastructure, including
25
data-mining and other advanced analytical tools, in

order to access, receive, and analyze data and infor-
1
mation in furtherance of the responsibilities under
2
this section, including by establishing a voluntary
3
mechanism whereby critical infrastructure owners
4
and operators may report information on emerging
5
threats, such as the threat posed by unmanned air-
6
craft systems.

(b) REPORT.—Not later than 1 year after the date
8
of the enactment of this Act, the Under Secretary for In-
9
telligence and Analysis of the Department of Homeland
10
Security shall prepare a threat assessment and report to
11
the Committee on Homeland Security of the House of
12
Representatives and the Committee on Homeland Security
13
and Governmental Affairs of the Senate on the threat
14
posed by unmanned aircraft systems, including informa-
15
tion collected from critical infrastructure owners and oper-
16
ators and Federal, State, and local government agencies.
17
Such assessment and report shall also include a classified
18
plan to mitigate such threat, as appropriate.

(c) DEFINITIONS.—

(1) CRITICAL
INFRASTRUCTURE.—The term
21
‘‘critical infrastructure’’ has the meaning given such
22
term in section 1016(e) of Public Law 107–56 (42
23
U.S.C. 5195c(e)).

(2) UNMANNED AIRCRAFT SYSTEM.—The term
1
‘‘unmanned aircraft system’’ has the meaning given
2
such term in section 331 of the FAA Modernization
3
and Reform Act of 2012 (49 U.S.C. 40101 note;
4
Public Law 112–95).
