diction of the committee concerned
A BILL
To amend the National Telecommunications and Information
Administration Organization Act to provide for the estab-
lishment of an electromagnetic spectrum sharing research
and development program and an integrated spectrum
automation enterprise strategy, and for other purposes.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Studying How to Har-
2
ness Airwave Resources Efficiently Act of 2019’’ or the
3
‘‘SHARE Act’’.

SEC. 2. NTIA ELECTROMAGNETIC SPECTRUM SHARING RE-
5
SEARCH AND DEVELOPMENT PROGRAM AND
6
STRATEGY.

Part A of the National Telecommunications and In-
8
formation Administration Organization Act (47 U.S.C.
9
901 et seq.) is amended by adding at the end the fol-
10
lowing:

‘‘SEC. 106. ELECTROMAGNETIC SPECTRUM SHARING RE-
12
SEARCH AND DEVELOPMENT PROGRAM AND
13
STRATEGY.

‘‘(a) RESEARCH AND DEVELOPMENT PROGRAM.—
15
Not later than 1 year after the date of the enactment of
16
the Studying How to Harness Airwave Resources Effi-
17
ciently Act of 2019, the Assistant Secretary, in consulta-
18
tion with the Commission, shall establish a program to re-
19
search and develop innovative technologies and techniques
20
that facilitate the sharing of the same covered electro-
21
magnetic spectrum by more than one Federal entity.

‘‘(b) DEVELOPMENT OF INTEGRATED SPECTRUM AU-
23
TOMATION ENTERPRISE STRATEGY.—
24
‘‘(1) IN GENERAL.—Not later than 1 year after
25
the date of the enactment of the Studying How to

Harness Airwave Resources Efficiently Act of 2019,

the Assistant Secretary, in consultation with the
2
Commission, shall propose, after notice and oppor-
3
tunity for comment, an integrated spectrum automa-
4
tion enterprise strategy to address the management
5
of covered electromagnetic spectrum in order to fa-
6
cilitate the sharing of such spectrum by more than
7
one Federal entity.

‘‘(2) MATTERS ENCOMPASSED.—In developing
9
the strategy under paragraph (1), the Assistant Sec-
10
retary shall consider, at a minimum, whether to pro-
11
pose—
12
‘‘(A) changes in policy or to the law, in-
13
cluding legislative and regulatory changes; and
14
‘‘(B) using—
15
‘‘(i) databases;
16
‘‘(ii) artificial intelligence;
17
‘‘(iii) spectrum management proc-
18
esses;
19
‘‘(iv) public-facing application pro-
20
gramming interfaces and online tools;
21
‘‘(v) automatic frequency coordination
22
systems;
23
‘‘(vi) spectrum enforcement require-
24
ments;

‘‘(viii) environmental sensing capabili-
2
ties; and
3
‘‘(ix) electromagnetic spectrum com-
4
patibility analyses.

‘‘(3)
ESTABLISHMENT
OF
SHARING
TEST
6
BED.—Not later than 15 months after the date of
7
the enactment of the Studying How to Harness Air-
8
wave Resources Efficiently Act of 2019, the Assist-
9
ant Secretary, in consultation with the Commission,
10
shall, as part of the strategy proposed under para-
11
graph (1), establish at least one test bed to dem-
12
onstrate the potential for automated technologies to
13
facilitate the sharing of the same covered electro-
14
magnetic spectrum by more than one Federal entity.
15
‘‘(4) UPDATES TO STRATEGY.—Not later than
16
1 year after the strategy under paragraph (1) is pro-
17
posed, and annually thereafter, the Assistant Sec-
18
retary shall update such strategy.

‘‘(c) REPORT.—Not later than 18 months after the
20
date of the enactment of the Studying How to Harness
21
Airwave Resources Efficiently Act of 2019, and annually
22
thereafter, the Assistant Secretary, in consultation with
23
the Commission, shall submit to the Committee on Energy
24
and Commerce of the House of Representatives and the

Committee on Commerce, Science, and Transportation of

the Senate a report containing—
2
‘‘(1) the results of the program established
3
under subsection (a); and
4
‘‘(2) the strategy proposed under subsection
5
(b)(1) with respect to the first report submitted
6
under this subsection and updates to the strategy
7
proposed under such subsection with respect to re-
8
ports submitted thereafter.
9
‘‘(d) AUTHORIZATION OF APPROPRIATIONS.—There
10
is authorized to be appropriated to the Assistant Secretary
11
to carry out this section $50,000,000 for fiscal year 2020.
12
Such amounts are authorized to remain available until ex-
13
pended.
14
‘‘(e) DEFINITIONS.—In this section:
15
‘‘(1)
COVERED
ELECTROMAGNETIC
SPEC-
16
TRUM.—The term ‘covered electromagnetic spec-
17
trum’ means electromagnetic spectrum allocated for
18
exclusive or primary use by Federal entities.
19
‘‘(2) FEDERAL ENTITY.—The term ‘Federal en-
20
tity’ has the meaning given such term in section
21
113(l).’’.

SEC. 3. FEDERAL COMMUNICATIONS COMMISSION REPORT

ON EXPANDING SPECTRUM SHARING TECH-
2
NIQUES.
3
(a) REPORT.—Not later than 12 months after the
4
first assignment of Priority Access Licenses through the
5
system of competitive bidding, after an opportunity for no-
6
tice and comment, the Federal Communications Commis-
7
sion shall submit to the Committee on Energy and Com-
8
merce of the House of Representatives and the Committee
9
on Commerce, Science, and Transportation of the Senate
10
a report that assesses and provides recommendations for
11
expanding upon and improving spectrum sharing tech-
12
niques developed for use in the 3.5 gigahertz band and
13
that includes the following considerations:
14
(1) How to promote an ecosystem of devices
15
employing such sharing techniques.
16
(2) How to ensure that any Federal protection
17
zones and corresponding technical rules and power
18
levels are no more protective than necessary.
19
(3) The applicability of such sharing techniques
20
to frequencies between 3100 megahertz and 3550
21
megahertz, inclusive, and frequencies between 7125
22
megahertz and 8400 megahertz, inclusive, to the ex-
23
tent any portion of such frequencies cannot be
24
cleared in a reasonable amount of time.

(b) RULE
OF CONSTRUCTION.—Nothing in sub-
1
section (a)(3) may be construed to require that every spec-
2
trum sharing technique developed for use in the 3.5
3
gigahertz band be recommended for use in other bands.
