manufacturers to give notice to consumers as to whether internet-con-
nected devices contain cameras or microphones.

Mr. GARDNER introduced the following bill; which was read twice and referred
to the Committee on Commerce, Science, and Transportation
A BILL
To require the Federal Trade Commission to promulgate
regulations requiring manufacturers to give notice to con-
sumers as to whether internet-connected devices contain
cameras or microphones.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Protecting Privacy in
4
Our Homes Act’’.

SEC. 2. DEFINITIONS.

(1) COMMISSION.—The term ‘‘Commission’’
1
means the Federal Trade Commission.
2
(2) COVERED DEVICE.—The term ‘‘covered de-
3
vice’’—
4
(A) means an internet-connected device a
5
component of which is a camera or microphone;
6
and
7
(B) does not include any device that is spe-
8
cifically marketed as a camera or microphone.

COVERED
MANUFACTURER.—The
term
10
‘‘covered manufacturer’’ means a manufacturer of a
11
covered device.

SEC. 3. REGULATIONS.

Not later than 180 days after the date of enactment
14
of this Act, the Commission shall promulgate regulations
15
under section 553 of title 5, United States Code, under
16
which each covered manufacturer shall be required to in-
17
clude on the packaging of each covered device manufac-
18
tured by the covered manufacturer a notice that a camera
19
or microphone is a component of the covered device.

SEC. 4. ENFORCEMENT.

(a) IN GENERAL.—This Act and the regulations pro-
22
mulgated under this Act shall be enforced by the Commis-
23
sion under the Federal Trade Commission Act (15 U.S.C.
24
41 et seq.).

(b) UNFAIR OR DECEPTIVE ACTS OR PRACTICES.—

A violation of this Act or a regulation promulgated under
2
this Act shall be treated as a violation of a rule defining
3
an unfair or deceptive act or practice prescribed under sec-
4
tion 18(a)(1)(B) of the Federal Trade Commission Act
5
(15 U.S.C. 57a(a)(1)(B)).

(c) ACTIONS BY THE COMMISSION.—
7
(1) IN GENERAL.—The Commission shall pre-
8
vent any person from violating this Act or a regula-
9
tion promulgated under this Act in the same man-
10
ner, by the same means, and with the same jurisdic-
11
tion, powers, and duties as though all applicable
12
terms and provisions of the Federal Trade Commis-
13
sion Act (15 U.S.C. 41 et seq.) were incorporated
14
into and made a part of this Act.

(2) PENALTIES AND PRIVILEGES.—Any person
16
who violates this Act or a regulation promulgated
17
under this Act shall be subject to the penalties and
18
entitled to the privileges and immunities provided in
19
the Federal Trade Commission Act (15 U.S.C. 41 et
20
seq.).
