SHORT TITLE. 1 This Act may be cited as the ‘‘Promoting American 2 Energy Jobs Act of 2019’’. 3 SEC. 2. SURVEY, ANALYSIS, AND REPORT ON EMPLOYMENT 4 AND DEMOGRAPHICS IN THE ENERGY, EN- 5 ERGY EFFICIENCY, AND MOTOR VEHICLE 6 SECTORS OF THE UNITED STATES. 7 (a) ENERGY JOBS COUNCIL.— 8 (1) ESTABLISHMENT.—The Secretary of En- 9 ergy (referred to in this section as the ‘‘Secretary’’) 10 shall establish a council, to be known as the ‘‘En- 11 ergy Jobs Council’’ (referred to in this section as the 12 ‘‘Council’’). 13 (2) MEMBERSHIP.—The Council shall be com- 14 prised of— 15 (A) to be appointed by the Secretary— 16 (i) one or more representatives of the 17 Energy Information Administration; and 18 (ii) one or more representatives of a 19 State energy office that are serving as 20 members of the State Energy Advisory 21 Board established by section 365(g) of the 22 Energy Policy and Conservation Act (42 23 U.S.C. 6325(g)); and 2 (ii) one or more representatives of the 3 Bureau of the Census; 4 (C) one or more representatives of the Bu- 5 reau of Labor Statistics, to be appointed by the 6 Secretary of Labor; and 7 (D) one or more representatives of any 8 other Federal agency the assistance of which is 9 required to carry out this Act, as determined by 10 the Secretary, to be appointed by the head of 11 the applicable agency. 12 (b) SURVEY AND ANALYSIS.— 13 (1) IN GENERAL.—The Council shall— 14 (A) conduct a survey of employers in the 15 energy, energy efficiency, and motor vehicle sec- 16 tors of the economy of the United States; and 17 (B) perform an analysis of the employment 18 figures and demographics in those sectors. 19 (B) perform an analysis of the employment 20 figures and demographics in those sectors, in- 21 cluding the number of personnel in each sector 22 who devote a substantial portion of working 23 hours, as determined by the Secretary, to compli- 24 ance matters. 25 VerDate Sep 11 2014 04:23 Dec 18, 2019 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6203 E:\BILLS\S2508.RS S2508 kjohnson on DSK79L0C42 with BILLS 4 •S 2508 RS (2) METHODOLOGY.—In conducting the survey 1 and analysis under paragraph (1), the Council shall 2 employ a methodology that— 3 (A) was approved in 2016 by the Office of 4 Management and Budget for use in the docu- 5 ment entitled ‘‘OMB Control Number 1910– 6 5179’’; 7 (B) uses a representative, stratified sam- 8 pling of businesses in the United States; and 9 (C) is designed to elicit a comparable num- 10 ber of responses from businesses in each State 11 and with the same North American Industry 12 Classification System codes as were received for 13 the 2016 and 2017 reports entitled ‘‘U.S. En- 14 ergy and Employment Report’’. 15 (3) CONSULTATION.—In conducting the survey 16 and analysis under paragraph (1), the Council shall 17 consult with key stakeholders, including— 18 (A) as the Council determines to be appro- 19 priate, the heads of relevant Federal agencies 20 and offices, including— 21 (i) the Secretary of Commerce; and 2 (v) the Administrator of the Environ- 3 mental Protection Agency; 4 (B) States; 5 (C) the State Energy Advisory Board es- 6 tablished by section 365(g) of the Energy Pol- 7 icy and Conservation Act (42 U.S.C. 6325(g)); 8 and 9 (D) energy industry trade associations. 10 (c) REPORT.— 11 (1) IN GENERAL.—Not later than 1 year after 12 the date of enactment of this Act, and annually 13 thereafter, the Secretary shall— 14 (A) make publicly available on the website 15 of the Department of Energy a report, to be en- 16 titled the ‘‘U.S. Energy and Employment Re- 17 port’’, describing the employment figures and 18 demographics in the energy, energy efficiency, 19 and motor vehicle sectors of the United States 20 based on the survey and analysis conducted 21 under subsection (b); Public Law 107–347), make the data col- 1 lected by the Council publicly available on the 2 website of the Department of Energy. 3 (2) CONTENTS.— 4 (A) IN GENERAL.—The report under para- 5 graph (1) shall include employment figures and 6 demographic data for— 7 (i) the energy sector of the economy 8 of the United States, including— 9 (I) the electric power generation 10 and fuels sector; and 11 (II) the transmission, storage, 12 and distribution sector; 13 (ii) the energy efficiency sector of the 14 economy of the United States; and 15 (iii) the motor vehicle sector of the 16 economy of the United States. 17 (B) INCLUSION.—With respect to each sec- 18 tor described in subparagraph (A), the report 19 under paragraph (1) shall include employment 20 figures and demographic data sorted by— 21 (i) each technology, subtechnology, 22 and fuel type of those sectors;
