SHORT TITLE. 1 This Act may be cited as the ‘‘Mapping Accuracy 2 Promotes Services Act’’ or the ‘‘MAPS Act’’. 3 SEC. 2. DEFINITIONS. 4 In this Act: 5 (1) BROADBAND INTERNET ACCESS SERVICE.— 6 The term ‘‘broadband internet access service’’ has 7 the meaning given the term in section 8.1(b) of title 8 47, Code of Federal Regulations, or any successor 9 regulation. 10 (2) COMMISSION.—The term ‘‘Commission’’ 11 means the Federal Communications Commission. 12 (3) PROVIDER.—The term ‘‘provider’’ means a 13 provider of fixed or mobile broadband internet access 14 service. 15 (4) QUALITY OF SERVICE.—The term ‘‘quality 16 of service’’ means information regarding offered 17 download and upload speeds and latency of a pro- 18 vider’s broadband internet access service as deter- 19 mined by and to the extent otherwise collected by 20 the Commission. 21 SEC. 3. ENFORCEMENT. 22 (a) IN GENERAL.—It shall be unlawful for a person 23 to willfully, knowingly, or recklessly submit broadband 24 internet access service coverage information or data to the 25 Commission for the purposes of compiling a broadband 26 VerDate Sep 11 2014 22:39 Dec 18, 2019 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H4227.RFS H4227 kjohnson on DSK79L0C42 with BILLS 3 HR 4227 RFS coverage map that is inaccurate with respect to the avail- 1 ability or quality of service of broadband internet access 2 service. 3 (b) PENALTY.—Any person who violates subsection 4 (a) shall be subject to an appropriate penalty, as deter- 5 mined by the Commission, under— 6 (1) the Communications Act of 1934 (47 7 U.S.C. 151 et seq.), including section 501 of that 8 Act (47 U.S.C. 501); and 9 (2) the rules of the Commission. 10 (c) EFFECTIVE DATE.— 11 (1) IN GENERAL.—Except as provided in para- 12 graph (2), subsection (a) shall apply with respect to 13 broadband internet access service coverage informa- 14 tion or data that is submitted to the Commission on 15 or after the date of the enactment of this Act. 16 (2) QUALITY OF SERVICE INFORMATION OR 17 DATA.—To the extent broadband internet access 18 service coverage information or data relates to qual- 19 ity of service, subsection (a) shall apply with respect 20 to information or data that is submitted on or after 21 VerDate Sep 11 2014 22:39 Dec 18, 2019 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H4227.RFS H4227 kjohnson on DSK79L0C42 with BILLS 4 HR 4227 RFS the date that is 180 days after the date of the enact- 1 ment of this Act. 2 Passed the House of Representatives December 16, 2019.
