A BILL
To amend title 18, United States Code, to provide for en-
hanced penalties for certain unlawful discharges of a
firearm on or near schools, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Justice for Victims
4
of School Shootings Act’’.
5
SEC. 2. SCHOOL SHOOTINGS.
6
Section 924(a)(4) of title 18, United States Code, is
7
amended—

(1) by striking ‘‘Whoever violates’’ and insert-
1
ing ‘‘(A) Except as otherwise provided in this para-
2
graph, whoever violates’’; and
3
(2) by adding at the end the following:
4
‘‘(B) Whoever violates section 922(q)(3) and
5
thereby causes harm to or the death of a person
6
through the use of a firearm, shall—
7
‘‘(i) for killing, or if death results to any
8
person from any other conduct prohibited by
9
this section, be punished by death or by impris-
10
onment for any term of years or for life, be
11
fined under this title, or both;
12
‘‘(ii) for assault resulting in serious bodily
13
injury, be imprisoned for not more than 30
14
years or fined under this title, or both; or
15
‘‘(iii) for attempting or conspiring to com-
16
mit an offense with the intent to cause the
17
death of any person, be imprisoned for not
18
more than 20 years or fined under this title, or
19
both.’’.

SEC. 3. DEFINITION OF ‘‘SCHOOL’’ REVISED TO INCLUDE IN-
21
STITUTIONS OF HIGHER EDUCATION.

Section 921(a)(26) of title 18, United States Code,
23
is amended to read as follows:

‘‘(26) The term ‘school’ means—

‘‘(A) a school which provides elementary or

secondary education, as determined under State
2
law; or
3
‘‘(B) for purposes of section 922(q)(3), a
4
college, university, or other postsecondary insti-
5
tution.’’.
