Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Next Generation Elec- 4 tric Systems Act of 2019’’. 5 SEC. 2. DEFINITIONS. 6 In this Act: 7 (1) ELIGIBLE ENTITY.—The term ‘‘eligible enti- 8 ty’’ means a partnership consisting of 2 or more en- 9 tities— 10 VerDate Sep 11 2014 03:17 Aug 08, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S2380.IS S2380 kjohnson on DSK79L0C42 with BILLS 2 •S 2380 IS (A) 1 or more of which shall be— 1 (i) an electric utility (as defined in 2 section 3(22)(A) of the Federal Power Act 3 (16 U.S.C. 796(22)(A))); 4 (ii) a Regional Transmission Organi- 5 zation (as defined in section 3 of the Fed- 6 eral Power Act (16 U.S.C. 796)); or 7 (iii) an Independent System Operator 8 (as defined in that section); and 9 (B) 1 or more of which may be— 10 (i) an institution of higher education 11 (as defined in section 101(a) of the Higher 12 Education Act of 1965 (20 U.S.C. 13 1001(a))); 14 (ii) a National Laboratory (as defined 15 in section 2 of the Energy Policy Act of 16 2005 (42 U.S.C. 15801)); 17 (iii) a State or local government or 18 other public body created by or pursuant 19 to State law; 20 (iv) an Indian tribe (as defined in sec- 21 tion 4 of the Indian Self-Determination 22 and Education Assistance Act (25 U.S.C. 23 5304)) or tribal organization (as defined in 24 VerDate Sep 11 2014 03:17 Aug 08, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S2380.IS S2380 kjohnson on DSK79L0C42 with BILLS 3 •S 2380 IS section 3765 of title 38, United States 1 Code); 2 (v) a Federal power marketing admin- 3 istration; 4 (vi) an entity that develops and pro- 5 vides technology; or 6 (vii) an organization described in sec- 7 tion 501(c)(3) of the Internal Revenue 8 Code of 1986. 9 (2) FEDERAL POWER MARKETING ADMINISTRA- 10 TION.—The term ‘‘Federal power marketing admin- 11 istration’’ means— 12 (A) the Bonneville Power Administration; 13 (B) the Southeastern Power Administra- 14 tion; 15 (C) the Southwestern Power Administra- 16 tion; and 17 (D) the Western Area Power Administra- 18 tion. 19 (3) SECRETARY.—The term ‘‘Secretary’’ means 20 the Secretary of Energy. 21 SEC. 3. GRID MODERNIZATION TECHNOLOGY DEMONSTRA- 22 TION PROJECTS. 23 (a) IN GENERAL.—The Secretary shall establish a 24 grant program under which the Secretary shall award 25 VerDate Sep 11 2014 03:17 Aug 08, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S2380.IS S2380 kjohnson on DSK79L0C42 with BILLS 4 •S 2380 IS grants to eligible entities to carry out eligible projects de- 1 scribed in subsection (b) relating to the modernization of 2 the electric grid, including— 3 (1) projects for the application of technologies 4 to improve observability, stability, advanced controls, 5 and prediction of system performance on the dis- 6 tribution system; and 7 (2) projects relating to transmission system 8 interconnections. 9 (b) ELIGIBLE PROJECTS.—An eligible project re- 10 ferred to in subsection (a) is a demonstration project 11 that— 12 (1) is designed to improve the resiliency, per- 13 formance, and efficiency of the future electric grid, 14 while ensuring the continued provision of safe, se- 15 cure, reliable, and affordable power; 16 (2) demonstrates secure integration and man- 17 agement of 2 or more energy resources, including 18 distributed energy generation, combined heat and 19 power, microgrids, energy storage, electric vehicles, 20 energy efficiency, demand response, intelligent loads, 21 and which may include resources behind the cus- 22 tomer meter; 23 VerDate Sep 11 2014 03:17 Aug 08, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S2380.IS S2380 kjohnson on DSK79L0C42 with BILLS 5 •S 2380 IS (3) demonstrates secure integration and inter- 1 operability of communications and information tech- 2 nologies relating to the electric grid; 3 (4) includes the development of a cybersecurity 4 plan written in accordance with guidelines developed 5 by the Secretary; 6 (5) includes a privacy effects analysis that eval- 7 uates the project in accordance with the Voluntary 8 Code of Conduct of the Department of Energy, com- 9 monly known as the ‘‘DataGuard Energy Data Pri- 10 vacy Program’’, or the most recent revisions to the 11 privacy program of the Department of Energy; and 12 (6) satisfies the eligibility requirements de- 13 scribed in section 545(a) of the Energy Security and 14 Independence Act of 2007 (42 U.S.C. 17155(a)). 15 (c) COMMUNITY OUTREACH.—An eligible project car- 16 ried out using a grant awarded under subsection (a) may 17 include education and outreach with community-based or- 18 ganizations and other private sector entities to help inform 19 the objectives of the project and communicate the results 20 of the project. 21 VerDate Sep 11 2014 03:17 Aug 08, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S2380.IS S2380 kjohnson on DSK79L0C42 with BILLS 6 •S 2380 IS SEC. 4.
