DESIGNATION OF HONOR AND REMEMBER FLAG 1 FOR FALLEN MEMBERS OF THE ARMED 2 FORCES. 3 (a) FINDINGS.—Congress makes the following find- 4 ings: 5 (1) Since the Revolutionary War, more than 6 1,000,000 members of the Armed Forces have paid 7 the ultimate price by sacrificing their lives in service 8 to the United States. 9 (2) The contributions of those fallen members 10 of the Armed Forces are deserving of national rec- 11 ognition. 12 (3) As of July 2019, there is no officially recog- 13 nized symbol that acknowledges members of the 14 Armed Forces who died in service to the United 15 States. 16 (b) DESIGNATION.—Chapter 9 of title 36, United 17 States Code, is amended by adding at the end the fol- 18 lowing new section: 19 ‘‘§ 904. Honor and Remember Flag for fallen members 20 of the Armed Forces 21 ‘‘(a) DESIGNATION.—The Honor and Remember 22 Flag created by Honor and Remember, Inc., is designated 23 as the symbol of the commitment of the United States to 24 honoring and remembering the lives of all members of the 25 VerDate Sep 11 2014 03:31 Aug 08, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S2371.IS S2371 kjohnson on DSK79L0C42 with BILLS 3 •S 2371 IS Armed Forces who have lost their lives in service to the 1 United States. 2 ‘‘(b) REQUIRED DISPLAY.—(1) The Honor and Re- 3 member Flag shall be displayed at the locations specified 4 in paragraph (3) on the days specified in paragraph (2). 5 ‘‘(2) The days specified in this paragraph are the fol- 6 lowing: 7 ‘‘(A) Armed Forces Day, the third Saturday in 8 May. 9 ‘‘(B) Memorial Day, the last Monday in May. 10 ‘‘(C) Flag Day, June 14. 11 ‘‘(D) Independence Day, July 4. 12 ‘‘(E) National POW/MIA Recognition Day. 13 ‘‘(F) Veterans Day, November 11. 14 ‘‘(G) In the case of display at the World War 15 II Memorial, Korean War Veterans Memorial, and 16 Vietnam Veterans Memorial (required by paragraph 17 3(C)), any day on which the flag of the United 18 States is displayed. 19 ‘‘(H) In the case of display at medical centers 20 of the Department of Veterans Affairs (required by 21 paragraph 3(H)), any day on which the flag of the 22 United States is displayed. 23 ‘‘(I) In the case of display at post offices of the 24 United States Postal Service (required by paragraph 25 VerDate Sep 11 2014 03:31 Aug 08, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S2371.IS S2371 kjohnson on DSK79L0C42 with BILLS 4 •S 2371 IS 3(I)), the last business day before a day specified in 1 subparagraphs (A) through (F) that in any year is 2 not itself a business day. 3 ‘‘(3) The locations specified in this paragraph are the 4 following: 5 ‘‘(A) The United States Capitol. 6 ‘‘(B) The White House. 7 ‘‘(C) The World War II Memorial, the Korean 8 War Veterans Memorial, and the Vietnam Veterans 9 Memorial. 10 ‘‘(D) Arlington National Cemetery. 11 ‘‘(E) Each national cemetery under the jurisdic- 12 tion of the National Cemetery Administration. 13 ‘‘(F) The buildings containing the official office 14 of— 15 ‘‘(i) the Secretary of State; 16 ‘‘(ii) the Secretary of Defense; 17 ‘‘(iii) the Secretary of Veterans Affairs; 18 and 19 ‘‘(iv) the Director of Selective Service. 20 ‘‘(G) Each major military installation, as des- 21 ignated by the Secretary of Defense. 22 ‘‘(H) Each medical center of the Department of 23 Veterans Affairs. 24 VerDate Sep 11 2014 03:31 Aug 08, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S2371.IS S2371 kjohnson on DSK79L0C42 with BILLS 5 •S 2371 IS ‘‘(I) Each post office of the United States Post- 1 al Service. 2 ‘‘(c) DISPLAY TO BE IN A MANNER VISIBLE TO THE 3 PUBLIC.—Display of the Honor and Remember Flag pur- 4 suant to this section shall be in a manner designed to en- 5 sure visibility to the public. 6 ‘‘(d) LIMITATION.—This section may not be con- 7 strued or applied so as to require any employee to report 8 to work solely for the purpose of providing for the display 9 of the Honor and Remember Flag or any other flag.’’. 10 (c) CLERICAL AMENDMENT.—The table of sections 11 at the beginning of such chapter is amended by adding 12 at the end the following new item: 13 ‘‘904. Honor and Remember Flag for fallen members of the Armed Forces.’’.
