COMMERCIAL RECREATION CONCESSIONS PILOT 1 PROGRAM. 2 The Act of June 14, 1926 (commonly known as the 3 ‘‘Recreation and Public Purposes Act’’) (43 U.S.C. 869 4 et seq.), is amended by adding at the end the following: 5 ‘‘SEC. 7. COMMERCIAL RECREATION CONCESSIONS PILOT 6 PROGRAM. 7 ‘‘(a) IN GENERAL.—Notwithstanding any other pro- 8 vision of this Act (including regulations), not later than 9 90 days after the date of enactment of this section, the 10 Secretary shall establish a pilot program to authorize com- 11 mercial recreation concessions on land patented or leased 12 under this Act. 13 ‘‘(b) CONCESSIONS AGREEMENTS.— 14 ‘‘(1) IN GENERAL.—In carrying out the pilot 15 program established under subsection (a), the Sec- 16 retary shall enter into not more than 10 agreements 17 with parties to whom the land described in sub- 18 section (a) has been patented or leased for the estab- 19 lishment of commercial recreation concessions on the 20 land covered by the agreement. 21 ‘‘(2) TERM.— 22 ‘‘(A) IN GENERAL.—An agreement entered 23 into under paragraph (1) shall be for a period 24 that is consistent with the period of time re- 25 quired to amortize the capital investment made 26 VerDate Sep 11 2014 04:35 Aug 13, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H4028.IH H4028 kjohnson on DSK79L0C42 with BILLS 3 •HR 4028 IH under the agreement but in any case not longer 1 than 20 years. 2 ‘‘(B) EXTENSION.—On a finding of satis- 3 factory performance, the Secretary may extend 4 the term of an agreement for 1 additional pe- 5 riod equal in length to the initial term. 6 ‘‘(3) THIRD-PARTY AGREEMENTS.— 7 ‘‘(A) IN GENERAL.—A party to an agree- 8 ment entered into under paragraph (1) may 9 enter into agreements with third parties for the 10 establishment of commercial recreation conces- 11 sions pursuant to the agreement entered into 12 under paragraph (1). 13 ‘‘(B) TERM.—An agreement entered into 14 under subparagraph (A) shall not be for a pe- 15 riod that is longer than the term of the agree- 16 ment entered into under paragraph (1). 17 ‘‘(c) USE OF FUNDS.—A party to an agreement en- 18 tered into under subsection (b)(1) shall not be required 19 to use revenue collected pursuant to the commercial recre- 20 ation concessions on the land covered by the agreement. 21 ‘‘(d) AUTHORIZED ACTIVITIES.—For the term of an 22 agreement entered into under subsection (b)(1), with re- 23 spect to land covered by the agreement, any activity de- 24 VerDate Sep 11 2014 04:35 Aug 13, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H4028.IH H4028 kjohnson on DSK79L0C42 with BILLS 4 •HR 4028 IH fined as permissible under parts 2920 and 2930 of title 1 43, Code of Federal Regulations, shall be permissible. 2 ‘‘(e) EFFECT.—The establishment of commercial 3 recreation concessions under subsection (b) shall not be 4 considered to be a change in use for purposes of this Act.’’. 5 Æ VerDate Sep 11 2014 04:35 Aug 13, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H4028.IH H4028 kjohnson on DSK79L0C42 with BILLS
