A BILL
To prohibit the Secretary of Veterans Affairs from making
payments to child care providers that employ individuals
charged with certain offenses, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘VA Child Care Protec-
4
tion Act of 2019’’.

SEC. 2. REQUIREMENTS FOR CHILD CARE PROVIDERS RE-

CEIVING PAYMENT FROM DEPARTMENT OF
2
VETERANS AFFAIRS.

(a) IN GENERAL.—Subject to subsection (b), the Sec-
4
retary of Veterans Affairs may not make a payment to
5
any child care center, child care agency, or child care pro-
6
vider that employs an individual who has been charged
7
with—
8
(1) a sex offense;
9
(2) an offense involving a child victim;
10
(3) a violent crime;
11
(4) a drug felony; or
12
(5) other offense that the Secretary determines
13
appropriate.

(b) EXCEPTION.—Payment may be made to a child
15
care center, child care agency, or child care provider, if
16
such child care center, child care agency, or child care pro-
17
vider has suspended the individual described in subsection
18
(a) from having any contact with children while on the
19
job until the case is resolved.
