A BILL
To amend title 5, United States Code, to provide for the
forfeiture of Federal retirement benefits for Federal em-
ployees convicted of certain crimes relating to the sexual
abuse of children, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘No Pensions For
4
Pedophiles Act’’.

SEC. 2. FORFEITURE OF FEDERAL RETIREMENT BENEFITS

FOR FEDERAL EMPLOYEES CONVICTED OF
2
CERTAIN CRIMES RELATING TO THE SEXUAL
3
ABUSE OF CHILDREN.

(a) IN GENERAL.—Section 8312 of title 5, United
5
States Code, is amended—
6
(1) in subsection (a)—
7
(A) by striking ‘‘or’’ at the end of para-
8
graph (1), by striking the period at the end of
9
paragraph (2) and inserting ‘‘; or’’, and by add-
10
ing after paragraph (2) the following:
11
‘‘(3) was convicted, on or after the date of the
12
enactment of the No Pensions For Pedophiles Act,
13
of an offense described in subsection (e), to the ex-
14
tent provided by that subsection.’’; and
15
(B) by striking ‘‘and’’ at the end of sub-
16
paragraph (A), by striking the period at the
17
end of subparagraph (B) and inserting ‘‘; and’’,
18
and by adding after subparagraph (B) the fol-
19
lowing:
20
‘‘(C) with respect to an offense described in
21
subsection (e), to the period after the date of convic-
22
tion.’’; and
23
(2) by adding at the end the following:
24
‘‘(e) An offense described in this subsection is any
25
offense within the purview of—

‘‘(1) section 1591 (relating to sex trafficking of
1
children) of title 18;
2
‘‘(2) chapter 109A (relating to sexual abuse) of
3
title 18, in any case in which the criminal conduct
4
occurred before the victim attained 18 years of age;
5
‘‘(3) chapter 110 (relating to sexual exploitation
6
and other abuse of children) of title 18; or
7
‘‘(4) section 2423 (transportation of minors) or
8
2425 (use of interstate facilities to transmit infor-
9
mation about a minor) of title 18.’’.

(b) ABSENCE FROM THE UNITED STATES TO AVOID
11
PROSECUTION.—Section 8313(a)(1) of title 5, United
12
States Code, is amended by striking ‘‘or’’ at the end of
13
subparagraph (A), by striking ‘‘and’’ at the end of sub-
14
paragraph (B) and inserting ‘‘or’’, and by adding at the
15
end the following:
16
‘‘(C) after the date of the enactment of the
17
No Pensions For Pedophiles Act, for an offense
18
described in section 8312(e); and’’.
