Mr. MARKEY introduced the following bill; which was read twice and referred
to the Committee on Small Business and Entrepreneurship
A BILL
To amend the Small Business Act to supplement the report-
ing requirements applicable to the Small Business Ad-
ministration, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘SBIR Expansion and
4
Accountability Act of 2019’’.
5
SEC. 2. AMENDMENTS TO THE SMALL BUSINESS ACT.

(a) GOALS OF THE SBIR PROGRAM.—Section 9(a)
7
of the Small Business Act (15 U.S.C. 638(a)) is amended
8
by adding at the end the following: ‘‘Additionally, it is the
9
sense of Congress that the goals of the Small Business

Innovation Research Program are to stimulate techno-
1
logical innovation, meet Federal research and development
2
needs, foster and encourage participation in innovation
3
and entrepreneurship by women and socially or economi-
4
cally disadvantaged individuals, and increase private-sec-
5
tor commercialization of innovations derived from Federal
6
research and development funding.’’.

(b) REPORTING REQUIREMENTS.—Section 9(b) of
8
the Small Business Act (15 U.S.C. 638(b)) is amended—
9
(1) in paragraph (7)—
10
(A) in subparagraph (F), by striking
11
‘‘and’’ at the end;
12
(B) in subparagraph (G), by adding ‘‘and’’
13
at the end; and
14
(C) by adding at the end the following:
15
‘‘(H) with respect to a Federal agency to
16
which subsection (f)(1) or (n)(1) applies, wheth-
17
er the Federal agency has satisfied the require-
18
ment under each applicable subsection for the
19
year covered by the report;’’;
20
(2) in paragraph (8), by striking ‘‘and’’ at the
21
end;
22
(3) in paragraph (9), by striking the period at
23
the end and inserting ‘‘; and’’; and
24
(4) by adding at the end the following:

‘‘(10) with respect to a Federal agency to which
1
subsection (f)(1) or (n)(1) applies and that the Ad-
2
ministration determines has not satisfied the re-
3
quirement under either applicable subsection, require
4
the head of that Federal agency to submit to the
5
Committee on Small Business and Entrepreneurship
6
of the Senate and the Committee on Small Business
7
of the House of Representatives a report regarding
8
why the Federal agency has not satisfied the re-
9
quirement.’’.

(c) ADDITIONAL RESOURCES FOR THE OFFICE OF
11
INVESTMENT AND INNOVATION.—Section 9(mm) of the
12
Small Business Act (15 U.S.C. 638(mm)) is amended—
13
(1) in paragraph (1), in the matter preceding
14
subparagraph (A), by striking ‘‘paragraph (3)’’ and
15
inserting ‘‘paragraphs (3) and (4)’’;
16
(2) by redesignating paragraphs (4), (5), and
17
(6) as paragraphs (5), (6), and (7), respectively; and
18
(3) by inserting after paragraph (3) the fol-
19
lowing:

‘‘(4) TRANSFER
TO
OFFICE
OF
INVESTMENT
21
AND INNOVATION.—Of the amount that a Federal
22
agency allocates for uses under paragraph (1), the
23
agency shall transfer 5 percent of that amount to
24
the Office of Investment and Innovation of the Ad-

SEC. 3. INCLUSION OF FEDERAL AVIATION ADMINISTRA-
3
TION IN THE SMALL BUSINESS INNOVATION
4
RESEARCH PROGRAM AND SMALL BUSINESS
5
TECHNOLOGY TRANSFER PROGRAM.

Section 40101(d)(2)(D) of title 49, United States
7
Code, is amended to read as follows:
8
‘‘(D) The Small Business Act (15 U.S.C.
9
631 et seq.), except that—
10
‘‘(i) section 9 of such Act (15 U.S.C.
11
638) shall apply; and
12
‘‘(ii) all reasonable opportunities to be
13
awarded contracts shall be provided to
14
small business concerns and small business
15
concerns owned and controlled by socially
16
and economically disadvantaged individ-
17
uals.’’.
