To direct the Secretary of Transportation to prescribe a motor vehicle safety
standard requiring new commercial motor vehicles to be equipped with
an automatic emergency braking system, to require automatic emergency
braking installed in commercial motor vehicles to be used while in oper-
ation, and for other purposes.

Mr. JOHNSON of Georgia (for himself, Mr. GARCI´A of Illinois, and Mrs. WAT-
SON COLEMAN) introduced the following bill; which was referred to the
Committee on Transportation and Infrastructure, and in addition to the
Committee on Energy and Commerce, for a period to be subsequently de-
termined by the Speaker, in each case for consideration of such provisions
as fall within the jurisdiction of the committee concerned
A BILL
To direct the Secretary of Transportation to prescribe a
motor vehicle safety standard requiring new commercial
motor vehicles to be equipped with an automatic emer-
gency braking system, to require automatic emergency
braking installed in commercial motor vehicles to be used
while in operation, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Safe Roads Act of
2
2019’’.

SEC. 2. MOTOR VEHICLE SAFETY STANDARD.

(a) MOTOR VEHICLE SAFETY STANDARD.—Not later
5
than 1 year after the date of the enactment of this Act,
6
the Secretary of Transportation shall—
7
(1) prescribe a motor vehicle safety standard
8
under section 30111 of title 49, United States Code,
9
that requires all commercial motor vehicles manufac-
10
tured after the effective date of the standard to be
11
equipped with an automatic emergency braking sys-
12
tem; and
13
(2) include standards that establish the per-
14
formance requirements for automatic emergency
15
braking systems.

(b) FEDERAL MOTOR CARRIER SAFETY REGULA-
17
TION.—Not later than 1 year after the date of the enact-
18
ment of this Act, the Secretary of Transportation shall
19
prescribe a regulation under section 31136 of title 49,
20
United States Code, that requires an automatic emergency
21
braking system installed in any commercial motor vehicle
22
in operation on or after the effective date shall be used
23
at any time during which the commercial motor vehicle
24
is in operation.

(c) DEFINITIONS.—In this section:

(1) AUTOMATIC
EMERGENCY
BRAKING
SYS-
1
TEM.—The term ‘‘automatic emergency braking sys-
2
tem’’ means a system on a commercial motor vehicle
3
that, based on a predefined distance and closing rate
4
with respect to an obstacle in the path of the vehi-
5
cle—
6
(A) alerts the driver of the obstacle; and
7
(B) if necessary to avoid or mitigate a col-
8
lision with the obstacle, automatically applies
9
the brakes of the vehicle.

(2) COMMERCIAL MOTOR VEHICLE.—The term
11
‘‘commercial motor vehicle’’ has the meaning given
12
such term in section 31132 of title 49, United
13
States Code.
