To amend title 23, United States Code, to improve defense
access road resilience, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Defense Access Road
4
Enhancement Act’’.
5
SEC. 2. TECHNICAL CORRECTIONS AND IMPROVEMENTS TO
6
DEFENSE ACCESS ROAD RESILIENCE.
7
Section 210 of title 23, United States Code, is
8
amended—

(1) in subsection (a), by striking ‘‘(a)(1) The

Secretary’’ and all that follows through the end of
2
paragraph (1) and inserting the following:

‘‘(a) AUTHORIZATION.—
4
‘‘(1) IN GENERAL.—When defense access roads
5
are certified to the Secretary as important to the na-
6
tional defense by the Secretary of Defense or such
7
other official as the President may designate, the
8
Secretary is authorized, out of the funds appro-
9
priated for defense access roads, to provide for—
10
‘‘(A) the construction and maintenance of
11
defense access roads (including bridges, tubes,
12
tunnels, and culverts or other hydraulic appur-
13
tenances on those roads) to—
14
‘‘(i) military reservations;
15
‘‘(ii) defense industry sites;
16
‘‘(iii) air or sea ports that are nec-
17
essary for or are planned to be used for
18
the deployment or sustainment of members
19
of the Armed Forces, equipment, or sup-
20
plies; or
21
‘‘(iv) sources of raw materials;
22
‘‘(B) the reconstruction or enhancement of,
23
or improvements to, those roads to ensure the
24
continued effective use of the roads, regardless

of current or projected increases in mean tides,
1
recurrent flooding, or other weather-related
2
conditions or natural disasters; and
3
‘‘(C) replacing existing highways and high-
4
way connections that are shut off from general
5
public use by necessary closures, closures due to
6
mean sea level fluctuation and flooding, or re-
7
strictions at—
8
‘‘(i) military reservations;
9
‘‘(ii) air or sea ports that are nec-
10
essary for or are planned to be used for
11
the deployment or sustainment of members
12
of the Armed Forces, equipment, or sup-
13
plies; or
14
‘‘(iii) defense industry sites.’’;
15
(2) in subsection (b), by striking ‘‘the construc-
16
tion and maintenance of’’ and inserting ‘‘construc-
17
tion, reconstruction, resurfacing, restoration, reha-
18
bilitation, and preservation of, or enhancements to,’’;
19
(3) in subsection (c)—
20
(A) by striking ‘‘him’’ and inserting ‘‘the
21
Secretary’’;
22
(B) by striking ‘‘construction, mainte-
23
nance, and repair work’’ and inserting ‘‘activi-

ties for construction, maintenance, reconstruc-

tion, enhancement, improvement, and repair’’;
2
(C) by striking ‘‘therein’’ and inserting ‘‘in
3
those areas’’; and
4
(D) by striking ‘‘condition for such train-
5
ing purposes and for repairing the damage
6
caused to such highways by the operations of
7
men and equipment in such training.’’ and in-
8
serting the following: ‘‘condition for—
9
‘‘(1) that training; and
10
‘‘(2) repairing the damage to those highways
11
caused by—
12
‘‘(A) weather-related events, increases in
13
mean high tide levels, recurrent flooding, or
14
natural disasters; or
15
‘‘(B) the operations of men and equipment
16
in such training.’’;
17
(4) in subsection (g)—
18
(A) by striking ‘‘he’’ and inserting ‘‘the
19
Secretary’’;
20
(B) by striking ‘‘construction which has
21
been’’ and inserting ‘‘construction and other ac-
22
tivities’’; and
23
(C) by striking ‘‘upon his demand’’ and in-
24
serting ‘‘upon demand by the Secretary’’; and

(5) by striking subsection (i) and inserting the

following:

‘‘(i) REPAIR
OF CERTAIN DAMAGES
AND INFRA-
3
STRUCTURE.—The funds appropriated to carry out this
4
section may be used to pay the cost of repairing damage
5
caused, or any infrastructure to mitigate a risk posed, to
6
a defense access road by recurrent or projected recurrent
7
flooding, sea level fluctuation, a natural disaster, or any
8
other current or projected change in applicable environ-
9
mental conditions, if the Secretary determines that contin-
10
ued access to a military installation, defense industry site,
11
air or sea port necessary for or planned to be used for
12
the deployment or sustainment of members of the Armed
13
Forces, equipment, or supplies, or to a source of raw mate-
14
rials, has been or is projected to be impacted by those
15
events or conditions.’’.
