A BILL
To authorize the Fallen Journalists Memorial Foundation
to establish a commemorative work in the District of
Columbia and its environs, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Fallen Journalists Me-
4
morial Act of 2019’’.

SEC. 2. DEFINITIONS.

In this Act:

(1) ELIGIBLE FEDERAL LAND.—

(A) IN GENERAL.—The term ‘‘eligible Fed-

eral land’’ means Federal land depicted as
2
‘‘Area I’’ or ‘‘Area II’’ on the map numbered
3
869/86501 B and dated June 24, 2003.
4
(B) EXCLUSION.—The term ‘‘eligible Fed-
5
eral land’’ does not include the Reserve (as de-
6
fined in section 8902(a) of title 40, United
7
States Code).

(2) FOUNDATION.—The term ‘‘Foundation’’
9
means the Fallen Journalists Memorial Foundation.

SEC. 3. ESTABLISHMENT OF MEMORIAL TO COMMEMORATE

THE COMMITMENT OF THE UNITED STATES

TO A FREE PRESS BY HONORING JOURNAL-
13
ISTS WHO HAVE SACRIFICED THEIR LIVES IN
14
SERVICE TO THAT CAUSE.

(a) COMMEMORATIVE
WORK
AUTHORIZED.—The
16
Foundation may establish a commemorative work on eligi-
17
ble Federal land to commemorate the sacrifices made by
18
journalists working as guardians of democracy and for a
19
free and independent press.

(b) COMPLIANCE WITH STANDARDS FOR COMMEMO-
21
RATIVE WORKS.—Chapter 89 of title 40, United States
22
Code, and other applicable Federal laws (including regula-
23
tions) shall apply to the establishment of the commemora-
24
tive work authorized under subsection (a).

(c) PROHIBITION ON USE OF FEDERAL FUNDS.—

The Foundation may not use Federal funds to establish
2
the commemorative work authorized under subsection (a).
3
(d) DEPOSIT OF EXCESS FUNDS.—
4
(1) ON ESTABLISHMENT OF COMMEMORATIVE
5
WORK.—If, on payment of all expenses for the estab-
6
lishment of the commemorative work authorized
7
under subsection (a) (including the maintenance and
8
preservation amounts required by section 8906(b)(1)
9
of title 40, United States Code), there remains a
10
balance of funds received for the establishment of
11
the commemorative work, the Foundation shall
12
transmit the amount of the balance to the account
13
provided for in section 8906(b)(3) of that title.

(2) ON EXPIRATION OF AUTHORITY TO ESTAB-
15
LISH
COMMEMORATIVE
WORK.—If, on expiration
16
under section 8903(e) of title 40, United States
17
Code, of the authority for the commemorative work
18
authorized under subsection (a), there remains a
19
balance of funds received for the establishment of
20
the commemorative work, the Foundation shall
21
transmit the amount of the balance to a separate ac-
22
count with the National Park Foundation for memo-
23
rials, to be available to the Secretary of the Interior
24
or Administrator of General Services, as appro-
