Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Greener Transpor- 4 tation for Communities Act’’. 5 SEC. 2. EXEMPT FACILITY BONDS FOR ZERO-EMISSION VE- 6 HICLE INFRASTRUCTURE. 7 (a) IN GENERAL.—Section 142 of the Internal Rev- 8 enue Code of 1986 is amended— 9 VerDate Sep 11 2014 03:32 Jul 03, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S2039.IS S2039 kjohnson on DSK79L0C42 with BILLS 2 •S 2039 IS (1) in subsection (a)— 1 (A) in paragraph (14), by striking ‘‘or’’ at 2 the end, 3 (B) in paragraph (15), by striking the pe- 4 riod at the end and inserting ‘‘, or’’, and 5 (C) by adding at the end the following new 6 paragraph: 7 ‘‘(16) zero-emission vehicle infrastructure.’’, 8 and 9 (2) by adding at the end the following new sub- 10 section: 11 ‘‘(n) ZERO-EMISSION VEHICLE INFRASTRUCTURE.— 12 ‘‘(1) IN GENERAL.—For purposes of subsection 13 (a)(16), the term ‘zero-emission vehicle infrastruc- 14 ture’ means any property (not including a building 15 and its structural components) if such property is— 16 ‘‘(A) made available for use by members of 17 the general public, and 18 ‘‘(B) used to charge or fuel zero-emissions 19 vehicles, but only if the property is located at 20 the point where the vehicles are charged or 21 fueled. 22 ‘‘(2) INCLUSION OF UTILITY SERVICE CONNEC- 23 TIONS.—The term ‘zero-emission vehicle infrastruc- 24 ture’ shall include any utility service connections, 25 VerDate Sep 11 2014 23:36 Jul 03, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S2039.IS S2039 kjohnson on DSK79L0C42 with BILLS 3 •S 2039 IS utility panel upgrades, or contributions in aid of con- 1 struction (as described in section 118) which are re- 2 quired for the charging or fueling of zero-emissions 3 vehicles. 4 ‘‘(3) ZERO-EMISSIONS VEHICLE.—The term 5 ‘zero-emissions vehicle’ means— 6 ‘‘(A) a zero-emission vehicle as defined in 7 section 88.102–94 of title 40, Code of Federal 8 Regulations, or 9 ‘‘(B) a vehicle that produces zero exhaust 10 emissions of any criteria pollutant (or precursor 11 pollutant) or greenhouse gas under any possible 12 operational modes and conditions. 13 ‘‘(4) ZERO-EMISSIONS VEHICLE INFRASTRUC- 14 TURE LOCATED WITHIN OTHER FACILITIES OR 15 PROJECTS.—For purposes of subsection (a), any 16 zero-emission vehicle infrastructure located within— 17 ‘‘(A) a facility or project described in sub- 18 section (a), or 19 ‘‘(B) an area adjacent to a facility or 20 project described in subsection (a) that pri- 21 marily serves vehicles traveling to or from such 22 facility or project, 23 shall be treated as described in the paragraph in 24 which such facility or project is described.’’. 25 VerDate Sep 11 2014 03:32 Jul 03, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S2039.IS S2039 kjohnson on DSK79L0C42 with BILLS 4 •S 2039 IS (b) EFFECTIVE DATE.—The amendments made by 1 this section shall apply to obligations issued after Decem- 2 ber 31, 2019. 3 Æ VerDate Sep 11 2014 03:32 Jul 03, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S2039.IS S2039 kjohnson on DSK79L0C42 with BILLS
