SLAUGHTER OF HORSES FOR HUMAN CONSUMP- 1 TION. 2 (a) IN GENERAL.—Chapter 3 of title 18, United 3 States Code, is amended by adding at the end the fol- 4 lowing: 5 ‘‘§ 50. Slaughter of horses for human consumption 6 ‘‘(a) OFFENSE.—It shall be unlawful to knowingly— 7 ‘‘(1) possess, ship, transport, purchase, sell, de- 8 liver, or receive, in or affecting interstate or foreign 9 commerce, any horse with the intent that it is to be 10 slaughtered for human consumption; or 11 ‘‘(2) possess, ship, transport, purchase, sell, de- 12 liver, or receive, in or affecting interstate or foreign 13 commerce, any horse flesh or carcass or part of a 14 carcass, with the intent that it is to be used for 15 human consumption. 16 ‘‘(b) PENALTY.—Any person who violates subsection 17 (a)— 18 ‘‘(1) shall be fined under this title, imprisoned 19 not more than 2 years, or both; or 20 ‘‘(2) in the case of a covered offense, shall be 21 fined under this title, imprisoned not more than 1 22 year, or both. 23 ‘‘(c) DEFINITIONS.—In this section— 24 ‘‘(1) the term ‘covered offense’ means a viola- 25 tion of subsection (a) in which— 26 VerDate Sep 11 2014 02:05 Jul 02, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S2006.IS S2006 kjohnson on DSK79L0C42 with BILLS 3 •S 2006 IS ‘‘(A) the defendant has no prior conviction 1 under this section; and 2 ‘‘(B) the conduct involves fewer than 5 3 horses or fewer than 2000 pounds of horse flesh 4 or carcass or part of a carcass; and 5 ‘‘(2) the term ‘horse’ means any member of the 6 family Equidae.’’. 7 (b) CLERICAL AMENDMENT.—The table of sections 8 for chapter 3 of title 18, United States Code, is amended 9 by adding at the end the following: 10 ‘‘50.
